SUBJECT: IAND EXCHANGE AGREEMENT IN CIVIC CENTER
Attached hereto is a proposed agreement executed by the Civic
Center Commission which provides for the exchange of land in
the Civic Center between the County and the City. Two parcels
of land each 8,820 square feet in size are involved, The County
will be trading a vacant area south of the Court House to the
City. This parcel is currently part of the Court House lease
and the City will use part of it for the construction of the
new Council chambers.
The second parcel which the City is trading to the County is
located immediately east of the Court House and will become the
site of the proposed Japanese garden. This proposed exchange
will enable the City to construct the new Council chambers as
now planned and will facilitate the obtaining of a title policy
for the entire City Hall construction site as required by bond
counsel. There are no funds involved in this land exchange.
RECOMMENDATION: That Council approve the attached land exchange
agreement.

WHEREAS, the CITY OF SANTA ANA, a municipal corpora-
lion duly organised and existing under the laws of the State
of California, and the COUNTY OF ORANGE, a subdivision of the
State of California, heretofore entered into a Joint Exercise
of Powers Agreement dated January 11, 1966, as amended, for
the purpose of establishing a comprehensive civic center in
the City of Santa Ana creating the "Orange County Civic Center
Authority"; and
WHEREAS, pursuant to said Agreement, the County has
previously constructed a Courthouse within the civic center;
and
WHEAEAS, the City presently desires to construct a
City Hall; and
WHEREAS, it is considered desirable that the City
Hall be constrvcted on a portion of the land which had previously
keen set aside for the construction of the Courthouse but is
not needed for the operation of said Courthouse; and

WHEREAS, both parties agree that the real property
previously set aside for the Courthouse site is not essential
to the operation of the Courthouse; and
WHEREAS, County desires to transfer to Authority its
interest in a parcel of land of the same site as is needed by
City for City Hall;
WHEREAS, a leasehold interest in said land is subject
to a trust indenture executed in connection with the financing
of said Courthouse; and
WHEREAS, Crocker-Citi2ens National Bank is designated
as Trustee under said Indenture; and
WHEREAS, under Section 6A9 of said Indenture, Crocker-
Citizens National Bank, as Trustee, has the power to release
said leasehold interest from said Indenture;
FOR A VALUABDE CONSIDERATION, receipt of which is
hereby acknowledged, and pursuant to an Agreement between the
City of Santa Ana, a municipal corporation duly organised and
existing under the laws of the State of California, and the
County of Orange, a subdivision of the State of California,
said Agreement entitled "Joint Exercise of Powers Agreement
Between the City of Santa Ana and the County of Orange Creat-
ing the Orange County Civic Center Authority," executed on
January 11, 1966, as amended, the County of orange, and Crocker-
Citizene National Bank, as Trustee under the above described
Indenture, hereby REMISE, REEEASE AND FOREVER QUITCLAIM, with-
out warranty, to the Orange County Civic Center Authority any
and all interests held by said parties in and to the following
described real property in the City of Santa Ana, County of

All that certain land in the City of Santa Ana, County
of Orange, State of California, being a portion of Sixth
Street as abandoned per Resolution 69-21 by the Santa Ana
City Council, recorded in Book 8818, page 863 of Official
Records, and a portion of the land conveyed to the County
of Orange per deed recorded in Book 7819, page 504, in tte
office of the County Recorder of safd County, and more
particularly described as follows:
Beginning at the Southeast corner of said land conveyed
to the County of Orange; thence Southerly along the
Southerly extension of the Easterly line of said land
30.00 feet to the Center Eine of Sixth Street as aban-
doned by said Resolution 69-27; thence Westerly along
said center line of Sixth Street 60.00 feet; thence
Northerly parallel with said Easterly line, and its
Southerly extension 141.00 feet; thence Easterly par-
allel with said center line of Sixth Etreet, 60.00
feet to said Easterly line; thence Southerly 111,00
feet to the point of beginning,
