• MOTION: Approve the Minutes of the September 12, 2011 meeting with
modifications from Commissioner Yrarrazaval to his remarks on the Town
& Country Plaza Manor project and to add Commissioner Mill's comment
regarding a neighbor's compliments to the PBA staff in regards to the
neighbor's renovation of his home on Starboard Street.

B. CONDITIONAL USE PERMIT NO. 2011-17
Filed by Paula Halverson, on behalf of The Wine Club, is requesting approval of a
conditional use permit for a Type 21 and Type 42 Alcoholic Beverage Control
(ABC) licenses for the off -premise sale and consumption of beer, wine and
distilled spirits and on-site tastings at 1431 South Village Way located in the Light
Industrial (M1) zoning district.
RECOMMENDATION:
Confirm the Zoning Administrator's action approving Conditional Use Permit No.
2011-17 as conditioned.

1. ZONING ORDINANCE AMENDMENT NO. 2011-01
(Continued by Planning Commission: March 28, 2011 to May 23, 2011; August 22, 2011 to September 12,
2011)
Filed by the City of Santa Ana, initiating a request to create a Housing
Opportunity Ordinance to ensure future residential development projects
contribute to the attainment of the affordable housing goals set forth in the
Housing Element of the City's General Plan.

RECOMMENDATION:
Recommend that the Planning Commission recommend that the City Council
adopt an ordinance approving Zoning Ordinance Amendment No. 2011-01.
Principal Planner Sergio Klotz presented the staff report and recommendation.
Commission discussion ensued regarding public outreach notification,
considerations for the Fixed Fee versus the Market Conditions methodologies,
sample in -lieu fee methodology; State requirements and role of the Housing
Authority to monitor affordable covenants, as well as discussion of rehabilitation
or new construction of off-site units.
Chairman Alderete voiced concerns that the Administrative Policies manual was
not included with the staff report. He requested to include the "Affordable Sales
Price Calculations Inclusionary Housing In -Lieu Fee Methodology" with the city
council packets.
• Katherine Head, Keyser Marston Associates, Inc. consultant provided an
extensive discussion of the fee methodology calculations, and administrative
procedures.
No written communications were received.

Cesar Covarrubias with The Kennedy Commission voiced his support for the
ordinance to ensure affordability to all segments of the community. He voiced
concern about potentially affecting projects that could qualify for tax credits by
making allowances for construction of off-site units, in lieu of including affordable
units in the new project, too restrictive.
There were no other speakers.
The public hearing was closed.
Commissioner Nalle stated he would support the ordinance but did not like the
State requirement. Commissioner Mill disagreed, stating we have an obligation,
whether State dictates or not, for residents of the city.
Commissioner Turner preferred per square footage fee and would like to have
methodology form included in the city council packets. He also requested copies
for the Planning Commissioners and staff obliged. He expressed concerns with
fixed -fees and "rehab projects"; stated benefit in promoting rehab projects, but
would also prefer flexibility in allowing new off-site affordable housing.
Commissioner Mill restated that the ordinance, as drafted, would ensure that
projects were mixed -income and not only affordable.
Chairman Alderete requested clarification on several proposed ordinance
requirements. Staff addressed the concerns.

Planning Manager Haluza thanked Principal Planner Sergio Klotz and Associate
Planner Melanie McCann for their facilitation of the Harbor Fair at Centennial
Park on Saturday, September 24, 2011 which was well attended.
Mrs. Haluza requested two volunteers from the Planning Commission to
participate in the Circulation Element workshop scheduled on Monday,
November 7, 2011 from 8:00 a.m. to 4:00 p.m. Commissioner Nalle agreed to
attend.

4. PLANNING COMMISSION MEMBER COMMENTS
Commissioner Yrarrazaval
• Requested status of repaving schedule for the Diamond Park Water
project. Public Works Agency will provide information.
• Commented that the subcontracting firm that handles graffiti throughout
city was not as effective as the city -run program. Mr. Trevino to follow up
• with the Public Works Agency.
Requested a study session to review landscape and land use issues.
