AGREEMENT FOR LEGAL SERVICES
THIS AGREEMENT, made and entered into this day
ofDeCery,L _V 1991, by and between the City of Santa Ana, a
municipal corporation of the State of California ("CITY"), and
Richard Politiski, Esq.("ATTORNEY").
W I T N E S S E T H
Recitals:
1. CITY desires to employ an attorney to assist the Personnel
Board as legal advisor for hearings before the Board.
2. ATTORNEY is licensed to practice law in the State of
California.
WHEREFORE, for and in consideration of their respective and
mutual covenants and agreements hereinafter contained, and subject
to all the terms and conditions hereof, the parties hereto do
hereby agree as follows:
A. EMPLOYMENT OF ATTORNEY
CITY hereby agrees to and does employ ATTORNEY, for the fees
hereinafter specified, to assist the Personnel Board of the City,
when and as requested by said Personnel Board in accordance with
their approved Rules of Procedure. ATTORNEY accepts said employment
and agrees to perform, in a timely and efficient manner, all of
such services as may be requested by the Personnel Board.
B. PAYMENT FOR SERVICES RENDERED
CITY agrees to pay to ATTORNEY, and ATTORNEY agree to accept,
as and for payment in full for all of said services, a fee equal to
the reasonable value of said services, determined at the rate of
sixty-five dollars ($65.00) per hour, provided, however, the total
fees payable hereunder for such services shall not exceed ten-
thousand dollars ($10,000) in any fiscal year without approval of
the City Council of city.
C. ATTORNEY INDEPENDENT CONTRACTORS
It is mutually agreed by and between the parties that, in the
performance of his covenants hereunder, ATTORNEY is and shall be an
independent contractor, and not an officer or employee of CITY.
E. TERM OF
The term of this Agreement shall commence on the date first
hereinabove written, and shall end on a date in the future, which
shall not be less than thirty (30) days from and after the date
when CITY informs ATTORNEY, in writing addressed to ATTORNEY at his
address hereinbelow specified, deposited in the United States mail,
postage prepaid, or when ATTORNEY inform CITY in writing, addressed
to the Executive Director of Personnel, 20 Civic Center Plaza,
Santa Ana, California 92701, deposited in the United States mail,
postage prepaid, of the date when this Agreement shall be
terminated.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written.
