Commissioners Acosta and Gartner noted their absence on April 23, 2012 as the reason for their abstention. * * * END OF CONSENT CALENDAR * * * Planning Commission Minutes Page 1 of 3 May 14, 2012 A BUSINESS CALENDAR Commissioners Acosta, Alderete, Gartner, Nalle, and Mill spoke individually with applicant Brent McManigal regarding the Walmart public hearing item. Commissioners Alderete and Turner discussed the Walmart public hearing item with Christine Iger from Iger & Associates Public Affairs. C. FISCAL YEAR 2012-2013 CAPITAL IMPROVEMENT PROGRAM RECOMMENDATION: Receive and file the draft Fiscal Year 2012-2013 Capital Improvement Program. Principal Civil Engineer Jason Gabriel provided a discussion regarding the Capital Improvement Program. Souri Amirani commented on the City's past practice of the Planning Commission's review of the CUP and indicated that the Commission is presented with an opportunity to review the report in order to determine if it is consistent with the General Plan. PROCEDURAL RULES PUBLIC HEARING 1. CONDITIONAL USE PERMIT NO. 2012-05 Filed by Brent McManigal representing Walmart Store, to allow a Type 21 Alcohol Beverage Control (ABC) license for the off- premise sale of beer, wine and distilled spirits at 3600 West McFadden Avenue located in the North Harbor Specific Plan (SP2) zoning district. PUBLISHED IN THE ORANGE COUNTY REPORTER: May 4, 2012 PUBLICLY NOTICED: May 3, 2012 RECOMMENDATION: 1. Adopting a resolution voiding Conditional Use Permit No. 2009-06. 2. Adopting a resolution approving Conditional Use Permit No. 2012-05 as conditioned. Planning Manager Haluza highlighted the information that was provided to the commission. Written communications were received: e-mail from David L. Elliott, President of Santa Ana Chamber of Commerce in support of project and Walmart Stats memo provided by Police Department Officer McCoy. Brent McManigal representing Walmart provided a presentation in support of the project. The public hearing was opened. No public members spoke. The public hearing was closed. MOTION: 1. PUBLIC COMMENTS (on non -agenda items) No public members spoke. 3. STAFF COMMENTS Planning Manager Haluza announced that the City of Santa Ana Transit Zoning Code was the 2012 Award Winner of The Driehaus Form -Based Codes Award presented at a ceremony held during the Congress for the New Urbanism on May 11, 2012. 4. PLANNING COMMISSION MEMBER COMMENTS Commissioners expressed concerns regarding the reported sale of the Santora building and the potential impact to the existing artists' community. Planning Manager Haluza provided information on the permitted uses, the protections afforded by the building's historic designation, and the formation of a City Council ad hoc committee to better understand the issues relating to the building. Commissioner Acosta inquired about city guidelines regarding hours of construction for projects on Saturday, in particular at the Vista Del Rio project, located at Memory Lane and City Drive.
