A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA ESTABLISHING A UNIFORM SCHEDULE OF
MISCELLANEOUS FEES FOR FISCAL YEAR 2012-2013
AND REPEALING IN PART RESOLUTION NO. 2011-031
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1: The City Council hereby, finds, determines and declares as follows:
A. Each year, for the convenience of the public the City Council gathers in a
single document a comprehensive listing of fees and service charges imposed by the
City upon that limited number of persons seeking services of value from the City.
B. This document is known as the "Miscellaneous Fee Schedule" for Fiscal
Year 2012- 2013 and is on file at the Clerk of the Council office, and incorporated by
this reference.
C. As part of approving the Miscellaneous Fee Schedule for Fiscal Year
2012- 2013, the various agencies of the City have analyzed the cost to administer the
various programs, activities and applications for which the City imposes fees or service
charges.
D. In certain circumstances, agencies have determined that the cost to the
City to process or undertake the services set forth in the Miscellaneous Fee Schedule
has increased over the prior fiscal year by approximately 1.6%, so that certain proposed
fees for Fiscal Year 2012-2013 have been increased by this percentage, or by this
amount rounded. This percentage reflects the change in the Consumers Price Index-
Urban, All Services Component, for the Los Angeles-Riverside-Orange County area in a
twelve month period ending December 31, 2011 (CPI).
E. The Council finds that the cost of providing the services set forth in the
Miscellaneous Fee Schedule has risen by 1.6% and that this reflects the cost of
administering certain programs, activities or applications for which the City levies
charges, fees or service charges. Such 1.6% increase does not exceed the City's
estimated reasonable cost to provide the pertinent service, process the specified
application or administer the certain program for which the charge, fee or service charge
is imposed.

F. Similarly, in a few limited circumstances, agencies have determined that
new charges should be added or existing charges raised beyond this 1.6%. Such
charges are listed in the `Proposed New Miscellaneous Fees' and 'Proposal to Modify
Existing Fees', attached to the staff report submitted for this matter, and made a part
hereof by this reference.
G. In order to have a single comprehensive document for Fiscal Year 2012 -
2013, the majority of fees which are unchanged have simply been reprinted in the
Miscellaneous Fee Schedule. The Council expressly states that it is not its intention to
repeal previously adopted fees and adopt new fees of exactly the same amount, but is
simply repeating these fees so that the Miscellaneous Fee Schedule can continue to be
a comprehensive source of City fees and service charges.
H. As to the City's Chapter 3 Appeal Hearing Fee, the Council further finds,
determines and declares:
1. The administrative costs incurred by the Clerk of the Council in
carrying out hearings normally exceeds the deposit fee collected
from applicants.
2. The actual charges incurred by the City for the services of an
administrative hearing officer, will be recovered from those persons
requesting such hearings.
1. As to the Water Meter Test Fee, the Council further finds, determines and
declares that the proposed modified fee will not be implemented or collected until the
City Council amends Santa Ana Municipal Code Section 39-24 to provide that the fee
may be set by resolution of the City Council.
J. In each of these cases, the Council finds, determines and declares that
such new or increased charges, fees or service charges do not exceed the City's
estimated reasonable cost to provide the pertinent service, process the specified
application or administer the certain program for which the charge, fee or service charge
is imposed.
K. Based upon the testimony, reports and other evidence submitted on these
matters, this City Council makes the above-specified findings.
Section 2: The Miscellaneous Fee Schedule for Fiscal Year 2012-2013 is
hereby adopted. Each fee or service charge set forth shall be levied until further
resolution of this Council.
Section 3: To the extent that any fee or service charge established pursuant to
Resolution No. 2012-022

City Resolution No. 2011-031 is inconsistent with the fees or service charges
established pursuant to this Resolution, then said Resolution No. 2011-031 is hereby
repealed.
Section 4: If any charge, fee, service charge, section, subsection, sentence,
clause, phrase or word of this Resolution is for any reason held to be invalid by a court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Resolution. The City Council hereby declares that it would have passed
and adopted this Resolution, and each and all provisions hereof, irrespective of the fact
that one or more provisions may be declared invalid.
Section 5: This Resolution shall be operative from and after July 1, 2012.

For Group activities, those groups for which at least 51% of participants
either live or work in the City of Santa Ana, the resident rate shall be applied.
LEISURE CLASSES

From time to time, privately taught leisure and instructional classes will be
offered by various agency divisions. The announcement of same will be made
by printed fliers or in the quarterly program booklet mailed to each residence
in the City. Programs so offered will be conducted in a 4-10 week format.
Charges for each class will be established by the Executive Director of Parks,
Recreation & Community Services. The City of Santa Ana will receive 30%
of the total fees collected from each of these leisure or instructional classes.

contract services and overtime are used to complete a portion of activity.

Unless otherwise provided, payment of fees and charges as
established herein shall be made to the Executive Director
of the Planning and Building Agency or his/her authorized
representative at the time of initial application or request for
the permit or service for which a fee is charged or imposed.

An application processing fee and plan checking fee shall be
paid to the Building Official at the time of submitting plans
for checking. Such fee shall be equal to 65% of the building
permit fee as set forth in this resolution. For all buildings,
such fee shall also include a surcharge for state mandated
energy conservation enforcement equal to $22.00 for each
1,000 square feet of building area, or fraction thereof, up to
4,000 square feet, and $11.00 for each additional 1,000
square feet or fraction thereof. For any plan submitted which

PROPOSED NEW MISCELLANEOUS FEES
PLANNING AND BUILDING AGENCY
1)OCFA Administrative Processing Fee
Proposed Fee: $15.00 per project which requires Orange County Fire Authority review or
permit.
Explanation:
The building permit counter will continue to serve as the primary submittal point for all permits
and plan checks which require Fire Department review following the transition from the City of
Santa Ana Fire Department to the Orange County Fire Authority (OCFA). City staff will be
responsible for: reviewing the scope of work to determine if Fire plan review is necessary,
ensuring that applicants properly complete OCFA applications, verifying that the applicant has
provided the correct number and type of plans, sorting and rolling the plans for distribution to
OCFA, accepting and processing both City fees and OCFA fees and tracking the status of plans
as they move through the plan check and permitting process. The fee proposed is consistent with
other Cities serviced by OCFA.

COMMUNITY DEVELOPMENT AGENCY
1)Enterprise Zone Hiring Tax Credit Application Processing Fee
Existing Fee: Per application $95.00

Retro-voucher fee per application $ 20.00
Expedited processing fee per application $ 30.00
Explanation: Qualified businesses within the designated State Enterprise Zone in the
City may apply for Hiring Tax Credit vouchers per employee hired within the zone.
Each voucher issued has the potential of generating over $37,000 in CA Tax Credits
for the employer. The application fee includes a $15.00 processing fee assessed by the
State Department of Housing and Community Development. With the loss in
Redevelopment funding, there is a need to increase the per application fee from $95 to
$100 to maintain the level of staffing and marketing budget as agreed upon in the
Memorandum of Understanding with the State.
A retro-voucher is any application that is 18 months past the employee hire date. The
fee is needed to cover the additional verification that is required for a retro-voucher.
The normal processing time for a voucher is 30 days. If the business requests the
voucher to be processed within 8 business days, an expedited fee will be assessed per
application.

The Parks, Recreation and Community Services Agency is proposing to increase Zoo
admission fees by $2.00. The only exceptions would be the Group Child/Senior rate
($1 increase) and the Half-Day Child/Senior rate ($1.50 increase). These groups are
mainly school field trips. Limiting the Half-Day Child/Senior increase to $1.50
instead of $2.00 will speed transactions and eliminate the need for change at the ticket
booth. Even with these Zoo fee increases, the Santa Ana Zoo admission fees are still
among the lowest for comparable zoos across the nation. An estimated $301,812 will
be generated from all of the Zoo admission fee increases.
4)Sports Youth Registration: Baseball, T-ball, basketball, flag football, kickball,
softball, soccer and volleyball

The Parks, Recreation and Community Services Agency is proposing to increase the
youth sports registration fee by $5 per registration. An additional $500 to $1,000 will
be generated from this fee increase. The proposed increase will help offset increased
program costs, including staff, trophies and t-shirts. Santa Ana’s Youth Sports
registration fees will remain lower than surrounding cities such as Orange ($79.00),
Tustin ($79.00), Garden Grove ($50.00) and Fountain Valley ($75.00).
PUBLIC WORKS AGENCY
5)Water Meter Test in Field/Shop
Existing Fee: $7.47
Proposed Fee: $96.00
Section 39-24 (a) of the municipal code allows a customer to request the City to test
the water meter serving their premises. The code currently requires the customer to
pay a deposit of $5.00 prior to the test. If the meter is found to register more than two
(2) percent above the actual volume of water consumed, the deposit is returned to the
customer.

The $5.00 deposit was originally set in the municipal code in 1968. The actual cost to
perform this test is significantly higher. At a minimum, it requires a trained city
worker two hours to pull a water meter in the field, transport it to a test bench, perform
the test, and reinstall the meter. The minimum cost to perform this work is currently
$96.00.
A proposed ordinance will allow the fee for a water meter test to be set by resolution.
Staff recommends that this fee be included in the Miscellaneous Fee Schedule and that
the fee be set at $96.00.

6)Chapter 3 Appeal Hearing Fee

Proposed Fee: $112.00 Deposit Fee (Applicant invoiced for Actual Cost of Hearing Officer)
Fee Description:
The City Council has a policy of full cost recovery. The $112.00 amount currently
charged does not cover the actual amount to hire an independent hearing officer to
consider the matter. The City has had a few cases over the past three years that cost the
residents over $1,000 each. The proposed amount would recover the actual cost,
excluding staff time.
