HomeMy WebLinkAbout2012-039 - Approving the Relocation Plan For the Grand Avenue Widening Project Between First and Fourth Street7/25/121ss RESOLUTION NO. 2012-039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING THE RELOCATION PLAN FOR THE GRAND AVENUE WIDENING PROJECT BETWEEN FIRST AND FOURTH STREET (PROJECT No. 08-1732) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: Section 1: The City Council of the City of Santa Ana ("Council") hereby finds, determines and declares as follows: A. Since 2006, the City of Santa Ana, in cooperation with the California Department of Transportation (Caltrans) and the Orange County Transportation Authority (OCTA) has designated the Grand Avenue Widening Project (the "Project") as a long term priority project. B. The first phase of the Project, between First Street and Fourth Street, will improve that section of roadway from a congested four- lane primary arterial to a six-lane multimodal street to meet the major arterial classification of the City General Plan Circulation Element and the County of Orange Master Plan of Arterial Highways, and the requirements of the US Department of Transportation, Federal Highway Administration. C. The Santa Ana Public Works Agency has identified ten (10) parcels which will be acquired to complete Phase I of the Project, affecting 17 commercial occupants and one residential tenant. D. Pursuant to California Government Code section 7260, et seq., a public entity is required to adopt a relocation plan, by resolution, whenever it enters into an agreement for acquisition of real property which would lead to displacement of people from their homes or commercial property. E. The relocation plan has been prepared in conformance with applicable provisions of the California Government Code §7260, et seq., Relocation Guidelines (California Code of Regulations, Title 25, Chapter 6), and the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (URA), and has been made available for public review since July 7, 2012. Each potential displaced occupant was given written notification regarding the Plan's availability. Resolution No. 2012-039 Page 1 of 3 F. The primary purpose of the Relocation Plan is to outline the requirements for moving and re-establishing the displaced residential and commercial occupants, and to demonstrate the level of advisory and financial assistance that will be provided. G. Based on occupant interviews, needs analyses, and searches for appropriate replacement sites, the Agency estimates relocation costs to be approximately $2,110,000. Section 2: In accordance with the California Environmental Quality Act, the proposed project has been determined to be adequately evaluated in the previously prepared FEIR (SCH No. 1998051068) approved by City Council in 2002. In accordance with National Environmental Policy Act, an Environmental Assessment document with a Finding of No Significant Impact was prepared for the proposed project and approved by the California Department of Transportation and Federal Highway Administration in 2011. Section 3: The City Council hereby approves the Relocation Plan for the acquisition activities for the Grand Avenue widening plan between First and Fourth Streets. Section 4: This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
