CONDITIONAL USE PERMIT NO. 2013-18 Tu Thanh Chu is requesting approval of a conditional use permit for a Type 41 Alcohol Beverage Control (ABC) license for the on-premise sale and consumption of beer and wine at the Quan de Thui 54 Restaurant at 5425 West First Street, Unit D, located in the Community Commercial (C1) zoning district. RECOMMENDATION: Confirm the Zoning Administrator's action approving Conditional Use Permit No. 2013-18 as conditioned. None WORK STUDY SESSION E. Planning Manager Karen Haluza discussed the project for the Bat Nha Meditation Institute of America that is proposing to construct an 8,600 square foot meditation center/temple at 803 South Sullivan Street. The 1.46 acre site currently consists of two parcels. The northern parcel (719 South Sullivan Street) currently contains a small single-family residence, with the south parcel the current home of Bat Nha. The rear of the site contains a few ancillary buildings and surface parking for the current use. The applicant is proposing to demolish all structures on both sites and construct atwo-level facility. The ground level, semi-subterranean will contain 115 parking spaces. The upper podium level will contain the worship space, office areas and landscaped gardens. Ms. Haluza reviewed the community outreach meetings that were held as well as the project entitlements. The project will require a conditional use permit to allow a church in the Single-Family (R-1) Residential zoning district, variances from the parking and height standards and a lot merger to combine the two lots into one parcel. Planning Commission Minutes 2 July 22, 2013 PROCEDURAL RULES PUBLIC HEARING 1. ZONING ORDINANCE AMENDMENT NO. 2013-01 (Continued by Planning Commission: July 8, 2013 to July 22, 2013) The City of Santa Ana is requesting approval of a zoning ordinance amendment to establish regulations related to emergency shelters, transitional housing and ' supportive housing for the homeless. PUBLISHED IN THE ORANGE COUNTY REPORTER: June 28, 2013 PUBLICLY NOTICED: June 27, 2013 RECOMMENDATION: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 2013-01. Associate Planner Melanie McCann presented the staff report and recommendation. She met with Lacy Neighborhood Association on July 19 to discuss the ordinance and the expansion of the existing Salvation Army facility. Ms. McCann indicated a neighborhood working group will be discussed at the July 24 meeting and commented on the letter from Jose Leal opposing the Salvation Army expansion. An email was received from Jose L. Leal in opposition to the expansion of the Salvation Army facility. ' Public hearing opened. Robert Cook stated the overlay zone does not include the Civic Center area and suggested pursuing the City-County to sell their vacant buildings. He also recommended changing the cobblestone material of the walkway in the City Hall courtyard area entering Council Chambers to assist the wheelchair constituents. Jose Leal, Lacy Neighborhood Association, spoke in opposition to the ordinance and Salvation Army expansion. Patricia Arroyo, landlord and former resident of Lacy neighborhood, requested more time to formulate impacts on the neighborhood and present to the City Council. Armando Olvera, working with Showers of Blessings, commented that he feeds homeless on Saturdays; provides clothing and seeks shelter; trying to build a shower with toilet facility in a donated trailer for the homeless . A plumber by trade, he requested assistance and direction to continue with his efforts to help veterans, homeless and the needy. ' Jean Watkins, Social Director at the Salvation Army, spoke in support of the facility expansion to assist the homeless and collaborate with the community; noted the Salvation Army has been a part of the neighborhood for over 40 years. Scott Larson, Executive Director for Home Aid, serves on Gounty Commission for the Homeless, commended the Planning staffs community outreach efforts and policy draft. He stated that Santa Ana has done more outreach than other Orange County cities and supports the ordinance. The public hearing was closed. Planning Commission Minutes 3 July 22, 2013 Commission discussed expanding the buffer requirement to 1,000 feet, but did not pursue it. The Commission encouraged the neighbors to continue working with the Salvation Army to resolve any issues. STAFF COMMENTS Robert Cook suggested salvaging the facades from the YMCA facility. He also commented on the unused structure on Ross Street. Executive Director Trevino commented on the two separate City Gouncil RFQs regarding rehabilitation/re-use of the YMCA building and the parking garage on 3 /Broadway. He also stated that the alcohol-entertainment ordinance is scheduled for City Council on August 5 - 2"d reading. C Planning Manager Haluza stated that applications for alcohol sales CUPs will no longer be heard by the Zoning Administrator and will instead come before the Planning Commission for public hearing. The Planning Commission meeting for August 12 has been cancelled due to lack of items. Planning staff will continue follow up on the work with the Salvation Army and the Lacy community work group sessions. 4. PLANNING COMMISSION MEMBER COMMENTS No comments requiring staff action. 5. EXCUSE OF ABSENCES Commissioner Yrarrazaval moved to excuse the absence of Chairman Alderete. The motion was seconded by Commissioner Nalle and approved by the Commission with a vote of 6:0.
