CONDITIONAL USE PERMIT NO. 2009 -13
10:37 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Leticia Aguilar; Applicant, Carlos Guaman, El Triunfo
Corporation, Oscar Villa, applicant's husband, Virginia Avila, Flower Park Neighborhood
Association, Toney Trujillo, Alejandro Flores, Assistant Planner II, Yolanda Pena & Mike
McCoy, Police Department, and Martha Ramirez, Recording Secretary.
Alejandro Flores presented the staff report and recommendation.
There were no written communications.
Public members speaking in support of the project: Virginia Avila, Toney Trujillo, Oscar
Villa, Carlos Guaman and Leticia Aguilar.
Zoning Administrator Klotz reviewed the criteria for denial: the premise located within
1,000 feet of another existing off - premise license location as well as located within
1,000 feet of school, church and park. The premise was determined to be over -
concentrated by the State Department of Alcoholic Beverage Control.
The Zoning Administrator adopted a resolution denying Conditional Use Permit No.
2009 -13. Mr. Klotz offered the option to appeal to the Planning Commission and
reviewed the appeal process and timeline with the applicant.
SAPID Officer McCoy stated that the ABC license remains with the property not the
applicant and /or owner.
No public comments were made.
The hearing adjourned at 11:13 a.m.
