MINOR EXCEPTION NO. 2009 -03
10:38 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Antonio Alvarez, Applicant; Matt Foulkes, Assistant Planner I;
and Jocelyn Magalona, Recording Secretary.
Matt Foulkes presented the staff report and recommendation.
There were no written communications.
Mr. Klotz referred to Condition 2 and stated the parking analysis by KOA Corporation
was for how Cancun Juice operates to make sure there is ample parking available. He
noted that should the vacant spaces also operate as restaurants, they too will have to
go through the same analysis to justify their request which may turn out differently.
Discussion followed regarding the outdoor area and patio furniture.
Mr. Klotz added Planning Condition 4 requiring any barrier on the outdoor seating area
be of either large potted plants or a decorative fence consisting of wrought iron and
pilasters to match the commercial building.
Mr. Klotz inquired if the applicant read and agreed to the conditions including the
modification. Mr. Alvarez stated his agreement to all the conditions.
The Zoning Administrator adopted a resolution approving Minor Exception No. 2009 -03
with modification to the conditions.
The hearing adjourned at 10:55 a.m.
