CONDITIONAL USE PERMIT NO. 2013 -03
10:36 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross
Annex Conference Room 2001.
Also in attendance were: Jeff Hall and Jeffrey Jensen, Applicants; Vince Fregoso, Principal
Planner; Nasser Rizk, Public Works; Mike McCoy, Police Department; Ryan Hodge, City
Attorney; and Jocelyn Magalona, Recording Secretary.
There were no written communications.
Mr. Fregoso presented the staff report and recommendation for approval.
The Police Department clarified Condition No. 14 regarding entertainment which once adopted
by City Council, a permit will be required.
Jeff Hall referred to Condition No. 3 and requested the hours allowed for sales, service and
consumption of alcoholic beverages be modified which resulted in further discussion and
clarification. The Zoning Administrator amended the hours from 8:00 a.m. and 12:00 midnight
to 6:00 a.m. and 12:00 midnight unless otherwise amended through the granting of an after -
hours conditional use permit.
Discussion was held regarding the outdoor dining area and encroachment permit from the
Public Works Agency. A condition was added requiring the applicant to submit an outdoor
dining permit subject to separate review and approval from the Public Works Agency.
The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2013 -03
with amended conditions.
The hearing adjourned at 10:59 a.m.
