CONDITIONAL USE PERMIT NO. 2012 -07
10:08 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Barry Hammond and Matt Sliwinski, Applicants; Ali
Pezeshkpour, Planning Intern; Eileen Greene, Police Department; Ryan Hodge, City
Attorney; and Jocelyn Magalona, Recording Secretary.
There were no written communications.
Mr. Pezeshkpour presented the staff report and recommendation for denial.
Mr. Hammond stated 7- Eleven is a national chain providing a convenience service as
well as an economic boost to the community and stated the State provides the ability to
grant a Public Convenience and Necessity (PCN) letter. Mr. Hammond presented
copies of the company's crime deterrence program, age awareness program and a
proposed draft conditions for approval. Mr. Sliwinski added that 7- Eleven has the
training and regulations in place.
The Zoning Administrator stated the City has regulations to ensure the community's well
being and the overconcentration of ABC licenses has the potential for negative impact
in the community and could not find a public convenience in granting a seventh liquor
license in the area.
Mr. Hammond stated the ABC license and after hours is a component of 7- Eleven and
would not go forward with the project if both are not approved. Mr. Hammond
suggested the ABC application be remanded to the Planning Commission and be heard
together with the after -hours application. Clarification of the procedure and appeal
process was provided. The Zoning Administrator considered the applicant's request
and saw no reason to remand the item.
The Zoning Administrator adopted a resolution denying Conditional Use Permit No.
2012 -07.
The hearing adjourned at 10:36 a.m.
