CONDITIONAL USE PERMIT NO. 2011 -17
10:40 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross
Annex Conference Room 2001.
Also in attendance were: Jim Hammer, Paula Halverson and Norm Nowell, Applicants; Ali
Pezeshkpour, Planning Intern; Vince Fregoso, Principal Planner; Yolanda Pena and Mike
McCoy, Police Department; and Jocelyn Magalona, Recording Secretary.
Ali Pezeshkpour presented the staff report update and recommendation for denial.
There were no written communications.
Mr. Hammer stated that the Wine Club will cancel their existing Type 20 ABC license should
Conditional Use Permit No. 2011 -17 be granted.
Discussion was held regarding the project's location, number of Police related incidents in the
• census tract, the users, and the voluntary cancellation of its current Type 20 ABC license.
Following the discussion, the Zoning Administrator made a determination to approve the
project based on its distant location from sensitive land uses, the low number of Police
related incidents, its sound reputation, and the voluntary cancellation of its Type 20 ABC
license.
Mr. Pezeshkpour presented a list of conditions for approval. The Police Department added a
condition prohibiting the sales of distilled spirits in pint sizes or smaller and the Planning
Department added a condition that the applicant cancel the existing Type 20 ABC license
prior to the issuance of a certificate of occupancy. Mr. Hammer agreed to all of the
conditions.
Mr. McCoy noted that the parking and lighting standards must be complied with prior to the
issuance of a Letter of Approval to the Alcohol Beverage Control Board.
The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2011-
17 with conditions.
The hearing adjourned at 11:04 a.m.
