HomeMy WebLinkAbout09/22/2010ZONING ADMINISTRATOR HEARING MINUTES SEPTEMBER 22, 2010 CONDITIONAL USE PERMIT NO. 2009 -22 10:37 a.m. Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross Annex Conference Room 2001. Also in attendance were: Maria Diaz and Senior Planner; Mike McCoy and Yolanda Magalona, Recording Secretary. There were no written communications. Citlaly Lepe, Applicants; Verny Carvajal, Pena, Police Department; and Jocelyn Verny Carvajal presented the staff report and recommendation. Ms. Pena added conditions regarding the serving of alcohol by a waiter or waitress only, the removal of graffiti within 24 hours or occurrence, the posting of a placard prohibiting loitering, that Penal Code Section 602 is complied with at all times, and that the premises may not be operated as a bar. Ms. Pena modified Police Condition 18 by separating the review clause and the lighting condition into two separate conditions. Mr. McCoy modified the parking reference in the lighting condition to include the entire parking lot. He also stated that the lighting standards be brought up to code prior to the issuance of Letter of Approval to the Alcoholic Beverage Control Board. Mr. McCoy cautioned the applicants that the business cannot operate as a banquet facility or night club, nor can they operate past midnight. Mr. Klotz clarified the banquet facility zoning. Ms. Lepe inquired if a permit is needed for a banquet facility. Mr. McCoy stated a permit is required. Mr. Klotz stated that if they want to operate a banquet facility in the future, they need to come back and go through a separate conditional use permit process. Ms. Pena asked for clarification of the proposed use of an area on the floor plan that looked like a dance floor. Ms. Diaz said it is for non fixed tables and chairs. Mr. Klotz asked if it was a dance floor and Ms. Lepe said no. Mr. McCoy modified Police Condition 5 to not allow strolling musicians and karaoke on the premises. He made clear that as the owner /manager of the restaurant it is their responsibility to not allow it and to remove them or they would be in violation of the condition. Mr. Klotz reviewed the modified conditions and asked the applicants if they understood and agreed to all of the conditions. Ms. Diaz stated her agreement. Mr. Klotz advised the applicants to stay in compliance and maintain a good track record. The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2009 -22 with modified conditions.
