The Motion is a “recommended action”. The Commission is not limited in any way by the Motion and may take any action which the Commission deems to be appropriate on an Agenda item. Except as otherwise provided by law, no action shall be taken on any item not appearing in the agenda. All supporting documentation for this Agenda is available for public review in the Planning Division during the business hours, 8:00 a.m. – 4:00 p.m., Monday through Friday. The Planning Division is located in City Hall, Ross Annex, Second Floor, 20 Civic Center Plaza, Santa Ana, California, (714) 667-2700. PUBLIC COMMENTS Pursuant to Government Code Sec. 54954.3, the public may comment on any agenda item under consideration by the Planning Commission, and on any other matters under the Commission’s jurisdiction. To speak, please register by submitting a completed “Request to Speak” form to the Commission Secretary. Speaker forms are available on the speaker’s podium and Chamber Lobby. To speak on an item on the Agenda, enter the Agenda item number on your speaker form. The Chairperson will call your name when that Agenda item is considered. To speak on an item not on the Agenda, check the Public Comments box on your speaker f orm. The Chairman will call your name during the Public Comments portion of the meeting. When speaking, please state your name and address. Limit your remarks to three (3) minutes. The number of speakers and allotted time may be limited at the discretion of the Chairperson. ROLL CALL PLEDGE OF ALLEGIANCE CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine by the Planning Commission and will be enacted by one motion without discussion. MINUTES RECOMMENDATION: Approve the minutes of the regular meeting of July 23, 2007. B. RECORDING SECRETARY REPORT Pursuant to the Brown Act, the July 23, 2007 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on July 20, 2007 at 8:33 a.m. Pursuant to the Brown Act, the August 13, 2007 Cancellation Notice for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on August 8, 2007 at 2:34 p.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. Planning Commission Agenda 4 August 27, 2007 C. MINOR EXCEPTION NO. 2007-01 (Ann Ni) Filed by P & M Developers/Dr. Mehdi Saghafi, to allow a reduction in the minimum parking requirement from 43 parking spaces to 40 parking spaces in the Community Commercial (C1) zoning district at 1401-1435 West First Street. RECOMMENDATION: Confirm the Zoning Administrator’s action approving Minor Exception No. 2007-01 as conditioned. D. CONDITIONAL USE PERMIT NO. 2007-13 (Vince Fregoso) Filed by El Pico de Gallo c/o Michael Cho, to allow a conditional use permit for a Type 41 Alcoholic Beverage Control license at El Pico de Gallo restaurant at 901 West Seventeenth Street. E. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) F. ABANDONMENT NO. 2006-04 (Ann Ni) Filed by the City of Santa Ana, to vacate a portion of 2701 North Grand Avenue located at the northeast corner of Grand and Fairhaven Avenues. RECOMMENDATION: Recommend that the City Council adopt a resolution approving Abandonment No. 2006-04. Planning Commission Agenda 5 August 27, 2007 G. CONDITIONAL USE PERMIT NO. 1962-92 (Bill Apple) Filed by Vietnamese American Buddhist Center for Charity Services, to finalize the landscape plan for property at 713 North Newhope Street. RECOMMENDATION: Approve the landscape plan for Conditional Use Permit No. 1962-92. H. NEIGHBORHOOD PROJECT REVIEW NO. 2007-14 (Melanie McCann) Filed by Victoria Betancourt, to permit the rehabilitation of the front porch for the property at 810 North French Street. RECOMMENDTION: Adopt a resolution approving Neighborhood Project Review No. 2007-14. APPEAL NO. 2007-04 (CONDITIONAL USE PERMIT NO. 2007-11) (Carlos Rodriguez) Filed by The Crosby restaurant to appeal conditions requiring alcoholic beverage sales only with food sales and to allow alcohol sales until 2:00 a.m. in the Central Business (C3) zoning district at 400 North Broadway.
