COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) Commissioner Bacerra spoke with both the developer and members of The Old Orchard Conservancy for the Sexlinger project. Commissioner Yrarrazaval spoke with Jeannie Gillett and Nick Spain with The Old Orchard Conservancy regarding the Sexlinger project. Commissioner Gartner spoke with representatives of Concordia University regarding the Sexlinger project. Commissioner Bauer received communications from the developer and spoke with Jeff Dickman regarding the Sexlinger property. Vice Chair Mill spoke with Mr. DeSnoo and Mr. Overbee, representatives of the property owner, as well as Jeannie Gillett and Nick Spain regarding the Sexlinger project. WORK STUDY SESSION C. TRAINING — DISCLOSURES AND EX PARTE COMMUNICATIONS Continued to February 24, 2014. D. REGIONAL COMMERCIAL CENTERS AND REGIONAL ATTRACTIONS PLANNED SIGN PROGRAMS Assistant Planner I Ali Pezeshkpour provided an overview of the proposed amendments to the Santa Ana Municipal Code for Planned Sign Programs since the last Commission hearing held on September 23, 2013, including definitions for regional automobile dealerships and the addition of language for electronic message displays. Public speakers: Raymond Rodriguez, President at Point of Sale Outdoor Media, provided a discussion on new signage options. Bob Bisno, 200 North Cabrillo Developer, commented that the proposed legislation was too restrictive and that the proposed ordinance was not business friendly. DISCUSSION OF THE DEPOT AT SANTIAGO, A PROPOSED 70 -UN11T MIXED USE RESIDENTIAL PROJECY AT 023 NORTH SANTIAGO STREET Senior Planner Verny Carvajal provided an update of the 70 -unit mixed use residential project with retail, community space, and underground parking. He indicated that a subdivision map and site plan review will be presented to the Planning Commission for approval. Todd Cottle with C &C Development provided an update on the proposed project highlighting the four -story design, architecture /materials, elevations, court yard type, parking, the project will be 100 percent affordable, and indicated that public outreach efforts will continue. Commission expressed support of the project. PROCEDURAL RULES PUBLIC HEARING 1. DENSITY BONUS AGREEMENT NO. 2014 -01 Todd Cottle, with Orange Housing Development Corporation (OHDC) and C & C Development (C &C), is requesting approval of a density bonus agreement in conjunction with the rehabilitation of a 10 -unit apartment building. The Density Bonus Agreement (DBA) will allow deviations from the maximum density and the required parking. PUBLISHED IN THE ORANGE COUNTY REPORTER: January 31, 2014 PUBLICLY NOTICED: January 30, 2014 RECOMMENDATION: Adopt a resolution approving Density Bonus Agreement No. 2014 -01 to allow deviations from maximum density and parking standards for multiple - family dwellings. Continue to February 24, 2014 at the request of staff. 2. FINAL ENVIRONMENT IMPACT REPORT NO. 2011 -01, VARIANCE NO.2012- 04, AND VESTINGTENTATIVE TRACT MAP NO. 2012 -02 Filed by Concordia University and Lutheran High School of Orange County, for Final Environmental Impact Report No. 2011 -01, Variance No. 2012 -04 and Vesting Tentative Tract Map No. 2012 -02 to allow a 23 -unit single family development at 1584 East Santa Clara Avenue located in the Single Family Residential (R1) zoning district. PUBLISHED IN THE ORANGE COUNTY REPORTER: January 31, 2014 PUBLICLY NOTICED: January 30, 2014 RECOMMENDATION: Recommend that the City Council: 1. Adopt a resolution certifying Final Environmental Impact Report No. 2011 -01 and approve the mitigation monitoring program for the Sexlinger Farmhouse and Orchard. Planning Commission Minutes Page 3 of 5 February 10, 2014 2. Adopt a resolution approving Variance No. 2012 -04 (a) for the Sexlinger Farmhouse as conditioned. 3. Adopt a resolution approving Variance No. 2012 -04 (b) to allow a reduction in the minimum lot frontage as conditioned. 4. Adopt a resolution approving Vesting Tentative Tract Map No. 2012 -02 (County Map No. 17231) as conditioned. Acting Planning Manager Vince Fregoso presented the staff report and recommendation. The public hearing was opened. Public speakers: Debbie Merced, Mark Maietta, John Lapworth, Kathi Lapworth, Jim Bright, Long Nguyen and Bea Tintilli spoke in support of the project. Virginia Mayne, Allen Lawson, Nick Spain, Deborah Rosenthal, Mathew Holbrook, Jeannie Gillett, Guy Stivers, Patrick Mitchell and Steve Ray spoke in opposition to the project. Michael Gibbons and Jeff Melching, representing the applicants, spoke in support of the project. Written communications in support of the project was received from William and Phyllis Stevens. Written communications in opposition to the project were received from Kathryn Thompson, Deborah M. Rosenthal, Jeannie Gillett and Bob Knight. The public hearing was closed. MOTION: Commissioner Yrarrazaval moved to continue the public hearing so that staff considers a better preservation alternative; EIR should consider the 50 -50 alternative, include conditions from the applicant and correct errors in the report. MOTION DIED FOR LACK OF A SECOND VOTE. Jeff Rice and Jeremy Holland with URS provided clarification on the alternatives analysis for the project. SUBSEQUENT MOTION: Recommend the City Council: 1. Adopt a resolution certifying Final Environmental Impact Report No. 2011 -01 and approve the mitigation monitoring program for the Sexlinger Farmhouse and Orchard. 2. Adopt a resolution approving Variance No. 2012 -04 (a) for the Sexlinger as conditioned. 3. Adopt a resolution approving Variance No. 2012 -04 (b) to allow a reduction in the minimum lot frontage as conditioned. 4. Adopt a resolution approving Vesting Tentative Tract Map No. 2012 -02 (County Map No. 17231) as conditioned. Planning Commission modified conditions: TTM12 -02 that the development shall have a minimum four foot landscaped parkway adjacent to the curve; Condition No. 15 Sexlinger Farmhouse's exterior be preserved utilizing the Secretary of Interior Standards for rehabilitation, and require orchard area to have minimum 10 existing trees plus six in -kind trees per the environmental report.
