PROJECTS)

D. TRAINING — DISCLOSURES AND EX PARTE COMMUNICATIONS
City Attorney Sonia Carvalho provided a presentation on Transparency & Fair
Process in relation to the law governing ex parte communications and due process.
A question and answer session ensued regarding the appropriateness of
communicating with the public, City Council, and other Planning Commissioners
regarding potential projects; also discussed communications with lobbyist and the
commissions desire to perform independent research and visit the site prior to
hearings.
PBA Interim Executive Director Karen Haluza provided an overview of the Ex Parte
Communications Form provided to the commission and its intent to document
commission communications on projects. City Attorney identified an option to invite
staff person in meeting with the applicants /developers. Staff noted that the
communication form will be accessible on the city's website.

PUBLIC HEARING
1. CONDITIONAL USE PERMIT NO. 2014 -05 AND VARIANCE NO. 2014 -01
Filed by Matt Molsberry representing the Boys and Girls Club of Santa Ana is
requesting a conditional use permit to allow the expansion of an existing
neighborhood community center and a variance to allow a reduction in the required
parking at 950 West Highland located in the Multiple - Family Residential (R3) zoning
district.

RECOMMENDATION:
1. Adopt a resolution approving Conditional Use Permit No. 2014 -05 as
conditioned.

Senior Planner Verny Carvajal presented the staff report and recommendation.
The public hearing was opened. Irma Macias and Brian Maguire voiced concerns
with open space and parking in the project vicinity. The public hearing was closed.
Lisa Gonzales - Solomon, Principal of Lowell Elementary School, spoke in support of
the project and commented on the verbal parking agreement between the schools
and the Boys & Girls Club.

2. FINAL ENVIRONMENTAL IMPACT REPORT NO. 2010 -01, AMENDMENT
APPLICATION NO. 2014 -01AND GENERAL PLAN AMENDMENT NO. 2014 -01
Town and Country Manor is proposing to construct an eight -story tower with174 one
and two - bedroom units and three levels of subterranean parking. The tower is
intended to provide housing for active seniors at the facility. An environmental
impact report, general plan amendment and zone change to a specific development
designation are required for the property at 555 East Memory Lane located in the
Suburban Apartment (R4) zoning district.

Commissioners Mill, Yrarrazaval, and Alderete praised Ritter's Steam Kettle Cooking
restaurant located at 1421 West MacArthur Boulevard.
5. EXCUSE OF ABSENCES
Commissioner Nalle motioned to excuse the absence of Commissioner Gartner. The
motion was seconded by Commissioner Bauer and unanimously approved by the
Commission with a vote of 6:0.
ADJOURNMENT 7:04 P.M The next meeting of the Planning Commission is scheduled
for Monday, March 24, 2013 at 5:30 p.m. in the Council Chamber, 22
Civic Center Plaza, Santa Ana, California
