CONDITIONAL USE PERMIT NO. 2014 -11 AND CONDITIONAL USE PERMIT NO. 2014 -12 Travis Hackett is requesting conditional use permits for after -hours operation and indoor commercial recreation at the eSports Arena computer gaming and spectator facility at 120 West Fifth Street located in the Transit/Downtown (SD84) zoning district. PUBLISHED IN THE ORANGE COUNTY REPORTER: May 16, 2014 PUBLICLY NOTICED: May 16, 2014 RECOMMENDATION: 1. Adopt a resolution approving Conditional Use Permit No. 2014 -11 as conditioned. 2. Adopt a resolution approving Conditional Use Permit No. 2014 -12 as conditioned. Ali Pezeshkpour, Assistant Planner I, presented the staff report and recommendation. Mike McCoy, Police Community Services Specialist, requested that Condition No. 2 be modified for CUP No. 2014 -11 to note that after -hours operations are permitted "until 2:00 a.m." and indicated the applicant is in agreement with added language. Public hearing was opened. Jack Jakowsky, property owner, and Tyler Endres, eSport Arena representative, spoke in support of the project. Public Hearing was closed. MOTION: 1. Adopt a resolution approving Conditional Use Permit No. 2014 -11 as conditioned to include after -hours operations "until 2:00 a.m." in Condition No. 2. 2. Matt Cereghino, representing OnTrac, noted support of project noting ideal location which is centrally located and close to freeways. Public Hearing was closed. CONDITIONAL USE PERMIT NO. 2014 -08 The Bella Cocina restaurant is applying for a conditional use permit to allow a Type 41 Alcoholic Beverage Control (ABC) license for the on- premise sale of beer and wine at 1501 West MacArthur Boulevard, Unit A, located in the General Commercial (C2) zoning district. Ricardo Soto, Planning Technician, presented the staff report and recommendation. Public hearing was opened. No written communications were received and there were no speakers on the matter. STAFF COMMENTS Mr. Fregoso announced the Planning Division won two awards for the Triada Project from SCAG (Southern California Association of Governments) and OCAPA (Orange Section of the American Planning Association California). PLANNING COMMISSION MINUTES 3 MAY 27, 2014 Ms. Haluza announced the Environmental Assessment/Draft Environmental Impact Report (EA/DEIR) for the Fixed Guideway (Streetcar) Project was released for public review and is currently in the 45 -day review comment period, noted the OCTA Board has been taking action on the project and there will be three public meetings for public comment with the first on Saturday, June 14 at Garfield Community Center from 9 a.m. to 12 p.m. The other meetings are listed on the Transit Vision website. 5. PLANNING COMMISSION MEMBER COMMENTS Commissioner Bacerra: • Congratulated staff on the awards adding he had the opportunity to witness the presentation of the OCAPA award. Commissioner Gartner: • Congratulated staff on the awards. Commissioner Yrarrazaval: • Congratulated staff on the awards. Vice Chair Mill: • Congratulated staff and members of the Commission who took part seeing The Triada project to fruition adding this is what a quality affordable housing project looks like. • Inquired on who provides water for the city. Mr. Fregoso noted 60% comes from city wells and 40% from the Metropolitan Water District. • Inquired if the group that uses the parking lot for the Farmers Market pay for the use of the lot. Mr. McCoy noted they are operating on a monthly permit and pay parking fees as part of the permit. • Noted the importance of completing the Disclosure forms by colleagues. Commissioner Nalle: • Echoed congratulations to staff on awards and thanked them for all their great work. Commissioner Bauer: Echoed congratulations to staff on awards. Chairman Alderete: • Echoed congratulations to staff on awards. • Thanked staff for their work and open thinking that helped bring eSports Arena to the city. • Welcomed Ricardo Soto noting he did a great job on his presentation. 6.
