A project overview was provided by Hally Soboleske, Associate Planner. Chairman Alderete opened the public hearing. Planning Commission discussion ensued regarding the floor plan and fire safety concerns with the patio seating in the private alley, the proposed use of the building, and the prior use at the space. Written communication was received from Cynthia Li regarding potential after hour noise concerns. The applicant fielded additional questions from the Planning Commission. There were no speakers and the hearing closed. MOTION: 1. Adopt a resolution approving Conditional Use Permit No. 2013 -32 to allow a Type 47 ABC license. 2. Adopt a resolution approving Conditional Use Permit No. 2013 -33 as conditioned to allow business operations until 2:00 a.m. 3. Adopt a resolution approving Conditional Use Permit No. 2013 -34 as conditioned to allow a banquet use. HARBOR BOULEVARD MIXED USE TRANSIT CORRIDOR SPECIFIC PLAN Legal noticed published in the Orange County Reporter on August 12, 2014 and notices mailed August 14, 2014. A project overview was provided by Karen Haluza, Interim Executive Director. Chairman Alderete opened the public hearing. A Planning Commission discussion ensued regarding details of the specific plan, specifically on- street parking and placement of a bicycle buffer between street traffic and parked vehicles. Zdenek Kekula, Senior Civil Engineer, fielded questions regarding pedestrian /cyclist safety concerns and reasons why a bicycle buffer was not recommended for the plan. • Blake Hopkins and Richard Kelter spoke in favor of the Harbor Boulevard Mixed Use Transit Corridor Specific. • Omar de la Rey, Alex Green and Marina Ramirez spoke in favor of bike buffers that separate bicyclists from traffic lanes and is looking to see that the Harbor Corridor be safer for bicyclists. • Dave Lopez provided written comments regarding code enforcement issues affecting Harbor Boulevard commercial and residential areas that he would like addressed. • Doug Browne had a question regarding the neighborhood transitional zone, changing from general commercial to residential, which is more compatible with surrounding neighborhoods. • Sien Diaz, a mobile homeowner, was concerned regarding how the adoption of the plan would affect the mobile home park he resides in. • Reshad Shah, a business owner, was concerned regarding how the adoption of the plan would affect his business in the future. MOTION: Recommend that City Council: 1. Adopt a resolution certifying Final Environmental Impact Report No. 2014- 01, to approve the mitigation monitoring program, findings of fact, and statement of overriding considerations for the Harbor Mixed Use Transit Corridor Specific Plan. 2. Adopt a resolution approving General Plan Amendment No. 2014 -02. 3. Adopt an ordinance approving Zoning Ordinance Amendment No. 2014 -01 with three conditions: 1) regarding Table 3 -8, add requirement that a minimum of four spaces be added for bicycle parking; 2) define parking facilities with language similar to shopkeeper definition regarding retaining space on the ground floor for use and operation by a retail merchant; 3) adopt the zoning ordinance without cross sections related to bicycle lanes and to bring back to the Planning Commission within 60 days the bike lanes for further discussion. 4. Adopt an ordinance approving Amendment Application No. 2014 -01. STAFF COMMENTS - No comments made. 7. PLANNING COMMISSION MEMBER COMMENTS Commissioner Bacerra: • Congratulated Vice Chairman Mill on his event; • Inquired on the status of the Adaptive Reuse Ordinance and when it is expected to be brought before the Commission. Commissioner Gartner: • Stated he's impressed with the Broadway construction, giving the city's gateway a more appealing look. Commissioner Yrarrazaval: • Echoed Commissioner Bacerra's congratulations to Vice Chairman Mill on his big event; • Echoed Commissioner Gartner's statement regarding the Broadway improvements. • Voiced his concerns with graffiti issues in the area of 806 -810 S. Townsend as well as trash /street sweeping issues on E. Pine and in the alleys near Ross /Durant Streets. Commissioner Bauer: • Congratulated Vice Chair Mill and thanked him for his patience tonight. Chairman Alderete: • Congratulated Vice Chairman Mill on his upcoming wedding; • Was impressed with Fourth Street Market applicant's presentation regarding preserving the Downtown area's diversity and helping business owners provide services to restaurant staff. 8.
