MOTION: Adopt a resolution approving the amendment to the Planning
Commission's By -Laws.

COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED
PROJECTS):
Vice Chair Mill disclosed that on August 24, 2013, Gil Marrero and Peter Zehnder
arranged for a bus trip to downtown Los Angeles along with Commissioner Bacerra,
Councilmember Benavides, and were met by Councilmember Tinajero, and viewed
several properties to see examples of how the adaptive reuse ordinance could help
in Santa Ana, as related to agenda item no. 4.
Commissioner Bacerra echoed the same disclosure as Vice Chair Mill, but stated
he did not speak with Mr. Zehnder until this afternoon.

CONDITIONAL USE PERMIT NOS. 2014 -21, 2014 -22 and 2014 -23
(Applicant: Eat Chow Restaurant)
Legal noticed published in the Orange County Reporter on August 26, 2014 and
notices mailed August 28, 2014.
A project overview was provided by Hally Soboleske, Associate Planner. Chairman
Alderete opened the public hearing. The applicant, Robert Thornton, answered
questions from the Commission regarding the enclosed patio seating. Written
communication was received regarding concerns with after hour noise impacts.
MOTION:
1. Adopt a resolution approving Conditional Use Permit No. 2014 -21 to allow a
Type 47 ABC license.
2. Adopt a resolution approving Conditional Use Permit No. 2014 -22 as
conditioned to allow business operations until 2:00 a.m.
3. Adopt a resolution approving Conditional Use Permit No. 2014 -23 as
conditioned to allow a banquet use.

A project overview was provided by Vince Fregoso, Acting Planning Manager.
Chairman Alderete opened the public hearing. Planning Commission discussion
ensued regarding discretionary approval of adaptive reuse projects, project
boundaries, adding another project area, open space, applicability of the Housing
Opportunity Ordinance, and the zoning language of the ordinance. Peter Zehnder
spoke in support of the amendment. There were no speakers and the hearing was
closed.
MOTION: Continue item to the September 22, 2014 Planning Commission
meeting.

5. STAFF COMMENTS
Vince Fregoso
• Mentioned that all Planning Commissioners have been signed up as members of
the American Planning Association (APA).
Mike McCoy
• Introduced Bill McGovern as his replacement when he retires in December after
34 years.
6. PLANNING COMMISSION MEMBER COMMENTS
Commissioner Mill:
• Thanked staff for help on bylaws and disclosure form.
• Noticed that City Council did not support establishments open until 4:00 a.m.
• Attended Annual Health & Fitness event last Saturday and was pleased to see
families in the Downtown.
Commissioner Yrarrazaval
• Inquired and received a reply to his question on where housing in lieu fees go.
Commissioner Bacerra
• Thanked Mike McCoy for his years of dedicated service to the community.
• Thanked staff for bringing the adaptive reuse ordinance to the Commission and
the work involved.
• Appreciated Commissioner Mill's modification to the proposed bylaws change as
he did not get the opportunity to express his comments earlier as he felt the item
was rushed to a vote.

• Requested that all future CUP exhibits /conditions include the after -hours time
being requested.
