1. Approve an Appropriation Adjustment recognizing $880,580 in Medical Marijuana
Registration Application and Regulatory Safety Permit revenue and appropriate to various
departmental budget accounts to offset the Medical Marijuana Dispensaries Enforcement
Plan costs from February to June 30, 2015.
2. Adopt a resolution amending the City's basic classification and compensation plan and to
amend the Fiscal Year 2014 -2015 annual budget to create ten Medical Marijuana
Dispensaries Enforcement Plan positions.
DISCUSSION
On November 4, 2014, the voters of the City of Santa Ana approved Measure BB (Ordinance No.
NS -2864) to regulate the establishment, operation, and taxation of Medical Marijuana Collectives
and Cooperatives. On November 18, 2014, in response to the voter approved measure, the City
Council approved the Medical Marijuana Dispensaries (MMD) Enforcement Plan to effectively
provide for the closure of illegal medical marijuana dispensaries and to ensure the monitoring of
permitted collectives /cooperatives operating legally under Measure BB.
As approved, the MMD Enforcement Plan requires the addition of staffing in various departments
that will work collaboratively to ensure ongoing compliance of the operational standards
established under Measure BB. The additional staffing is comprised of one Police Sergeant and
five Police Officer positions in the Police Department, two Community Preservation Inspector
positions in the Planning and Building Agency, one Revenue and Contract Compliance Examiner
position in the Finance & Management Services Agency, and one Assistant City Attorney position
and funding for contractual services in the City Attorney's Office.

The revenues collected as part of the Medical Marijuana Collective /Cooperative registration
application and regulatory safety permit process will offset the MMD Enforcement Plan costs for
the period of February to June 30, 2015. MMD Enforcement Plan costs commencing July 1,
2015 will be offset by the gross receipts tax revenue which are anticipated to be adopted as part
of the 2015 -16 budget process.
Staff recommends the approval of the appropriation adjustment and staffing to ensure the
effective implementation of the MMD Enforcement Plan.
STRATEGIC PLAN ALIGNMENT
Approval of this item supports the City's efforts to meet Goal #1 Community Safety, Goal #4 City
Financial Stability, and Goal #5 Health, Livability, Engagement & Sustainability.
FISCAL IMPACT
The appropriation adjustment will recognize $638,860 in MMD Registration Application Fees
(acct no. 01116002 - 53626) and $241,720 in anticipated MMD Regulatory Safety Permit (acct no.
01114002 - 51706) revenue to offset MMD Enforcement Plan costs from February to June 30,
2015.

RESOLUTION NO. 2015-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA TO AMEND AND REESTABLISH THE CITY'S
BASIC CLASSIFICATION AND COMPENSATION PLAN TO
ADD ONE NEW FULL -TIME CLASSIFICATION TITLE,
RESCIND RESOLUTION NO. 2015 -005, AND TO AMEND THE
CURRENT ANNUAL BUDGET TO ADD TEN FULL -TIME
POSITIONS TO ENSURE COMPLIANCE WITH THE MEDICAL
MARIJUANA DISPENSARIES ENFORCEMENT PLAN.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1: The City Council hereby finds, determines and declares as follows:
A. Section 1004, Article X of the City Charter of the City of Santa Ana
requires the City Manager to prepare, install and maintain a position
classification and pay plan subject to civil service rules and regulations
and the approval of the City Council.
B. On February 3, 2015, the City Council passed and adopted Resolution
No. 2015 -005, amending and reestablishing the Basic Classification and
Compensation Plan for all Full -Time and Part -Time Classifications of
Employment, excepting Executive Management, of the City of Santa Ana.
C. The City Council has amended and reestablished the Basic Classification
and Compensation Plan on numerous occasions since its adoption.
D. The City of Santa Ana's Position Classification and Pay Plan for all Full -
Time and Part -Time Classifications of Employment, is attached hereto as
Exhibits "A" through "H ", and is made a part hereof, excepting Executive
Management classifications which are maintained through separate
Resolution.
E. On July 1, 2014, the City Council passed and adopted Ordinance No.
NS -2867, establishing the City's Budget and authorizing position
allocations for Fiscal Year 2014 -2015, and requiring that alterations in the
allocation of authorized positions be reviewed and approved by the City
Council.
F. On November 18, 2014, the City Council adopted the Medical Marijuana
Dispensaries Enforcement Plan in response to voter - approved Measure
BB, City Establishment of Medical Marijuana Collectives and
Cooperatives. This Plan established the timeline and additional staffing
required to focus on gaining rapid closure of any illegally operating
collectives /dispensaries, and to ensure compliance of legally operating,

permitted medical marijuana collectives /cooperatives through ongoing
enforcement and monitoring, in accordance with Ordinance No. NS -2864.
G. In order to monitor revenues and ensure contract compliance in relation to
the Medical Marijuana Dispensaries Enforcement Plan, the Executive
Director of Finance and Management Services proposes creating the full -
time classification title of Revenue and Contract Compliance Examiner
(see Exhibit E) in the Position Classification and Pay Plan.
H. In keeping with the Medical Marijuana Dispensaries Enforcement Plan and
operational standards outlined in Ordinance No. NS -2864, the City
Manager proposes adding ten (10) full -time positions in the current Fiscal
Year 2014 -2015 Budget.
It is now desired to rescind Council Resolution No. 2015 -005, amend and
reestablish the Basic Classification and Compensation Plan for all Full -
Time and Part -Time Classifications of Employment, excepting Executive
Management, and amend the Adopted Budget for Fiscal Year 2014 -2015,
as amended, in order to effect these changes.
Section 2: That Ordinance No. NS -2867, the Annual Budget for Fiscal Year
2014 -2015, as amended, shall be further amended by:
A. Adding one (1) full -time position in the City Attorney's Office, at the
monthly seventeen -step salary rate range as indicated:

Employment, excepting Executive Management; and amending Ordinance No. NS-
2867, the Annual Budget for Fiscal Year 2014 -2015, as amended, shall remain in full
force and effect.
Section 5: This Resolution is operative from and after its date of adoption.
