RESOLUTION NO. 2015 -010
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA REVISING THE WATER AND SEWER RATES
AND CHARGES
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1: The City Council of the City of Santa Ana hereby, finds, determines
and declares as follows:
A. Santa Ana Municipal Code, Chapter 39, Article II regulates connection to
water mains within the City.
1. Pursuant to Santa Ana Municipal Code section 39.21 the City Council
shall set metered water rates by resolution.
2. The metered water rate shall be set to maintain a potable water supply
and provide standby readiness.
3. It is necessary to increase the metered water rate to reimburse the City for
increased costs of repair, replacement, and maintenance of the water
system and facilities, including increased materials, labor and overhead
costs and water capital improvement program costs.
B. Santa Ana Municipal Code, Chapter 39, Article III regulates connection to
sewer mains within the City.
1. Pursuant to Santa Ana Municipal Code section 39.55.4 the City Council
shall set reasonable sewerage service fees by resolution. Said fee shall
be used to operate, maintain, repair and replace the City owned sewer
system and facilities.
2. It is necessary to increase the sewer service charge to reimburse the City
for increased costs of repair, replacement and maintenance of the sewer
system and facilities, including increased materials, labor and overhead
costs and sewer capital improvement program costs.
3. The rate increase will be placed into a fund that will be used only to repair
and replace sewer mains and laterals located within the street right of
way, and which have outlived their useful life and provide preventive
maintenance and operation of the sewer collection system. No moneys
from this fund would be placed in the city's general fund.

4. There is a reasonable relationship between the imposition of the fee
imposed in that the use of the sewer creates an impact on its condition,
requiring its maintenance, repair and replacement.
C. On December 2, 2014, the City Council of the City of Santa Ana directed
staff to prepare all required documents necessary to proceed with water and sewer rate
adjustments.
D. A notice of public hearing of the proposed changes to the water and sewer
rates was mailed to each rate payer not less than 45 days prior to the public hearing in
compliance with Section 6 of Article XIII -D of the Constitution of the State of California.
E. On February 17, 2015, the City Council of the City of Santa Ana held a
noticed public hearing to review the proposed metered water rate and sewer rate
increases.
F. The revised water and sewer rates and charges set forth herein do not
exceed the estimated reasonable costs of providing services or facilities for which such
fees and rates are imposed.
G. Based upon the testimony, reports and other evidence submitted on these
matters, this City Council makes the findings contained in this resolution and authorizes
the adjustment of water and sewer rates and charges.
Section 2: The Basic Water Service Charge is hereby set with effective dates
as follows:

Section 3: The Metered Water Rate is hereby set with effective dates as
follows:

Multifamily dwellings are charged the Tier 1 rate for consumption between 0 -44 ccf of
water per dwelling unit and the Tier 2 rate for consumption over 45 ccf per dwelling unit.
Section 4: The Private Fire Service Charge is hereby set with effective dates
as follows:

Section 5: Pass - Through adjustments are hereby set as follows:
A. Increases or decreases of the cost of water may only be implemented if
costs exceed or fall short of the projected baseline level in the City's rate study and will
be calculated on an annual basis.
B. The pass- through cost applies only to the commodity component (metered
water rate) of the water used and will be assessed on all water consumption by a
customer.
C. A notice of at least 30 days will be provided to customers before any such
adjustments will take effect.

D. The formula for which the automatic pass- through charge is calculated is
as follows:

Definitions of Variables used in the Pass - Through charge formula:
Revised Supply Cost = cost of water based on provided water purveyor rates, basin
pumping percentage for the current year and electricity costs.
Revised Water Supplied = water consumption for current year.
Study Supply Cost = estimated cost of water based on provided water purveyor rates,
basin pumping percentage at the time of the rate study and electricity costs.
Study Water Supplied = estimated water demand at the time of the rate study.
Section 6: The Sanitary Sewer Charge is hereby set with effective dates as
follows:

Sanitary sewer customers which do not receive water service from the City of Santa
Ana will be charged the bi- monthly flat charge in effect.
Section 7: If any charge, fee, section, subsection, sentence, clause, phrase or
word of this Resolution is for any reason held to be invalid by a court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this
Resolution. The City Council hereby declares that it would have passed and adopted
this Resolution, and each and all provisions hereof, irrespective of the fact that one or
more provisions may be declared invalid.

Section 8: The increased metered water rate and sanitary sewer fees shall be
operative from and after March 1, 2015.
