F411W ri) THIS FIRST AMENDMENT TO AGREEMENT is entered into on August lst, 2006, by and between H.P.L. Mechanical, Inc., a California corporation ("Consultant') and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS: A. The parties entered into Agreement N-2006-050, dated June 1, 2006, (hereinafter "said Agreement") by which Consultant was contracted to repair a gas leak at the Depot in Santa Ana. B. During the course of repair, additional services were required. C. In accordance with the terms and conditions of said Agreement, the parties wish to increase the compensation available to pay for the additional services provided by Consultant. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Agreement, the parties agree as follows: Section 2.a., COMPENSATION, shall be amended to increase compensation by $1602. The total amount to be paid for repairs during the 2006-2007 fiscal year shall not exceed $1602.00. 2. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect.
