This First Amendment ("Amendment ") is entered into this !!L
day of iJ 01.2015-and amends the
Settlement Agreement and Mutual and General Release entered into by Scott Peebter, the City of Santa Ana,
and the Successor Agency to the Former Redevelopment Agency of the City of Santa Ana on November 14,
2014 (the "Agreement ").
Recitals
A. This parties intend that this Amendment clarifies that certain litigation costs awarded by the trial court in
Peebter v. Department of Finance, Sacramento County case number 3420 1 2- 80001 1 72 -CU -W M -GDS shall be
paid out of the Pechter Fund,
Agreements
The Parties therefore agree as follows:
1. The following subsection d. is added to Section 2 of the Agreement:
"°d. Costs awarded by the trial court against Petitioner to Respondent Department of Finance in the
amount of $998.75. City shall transmit this amount to UCI from the Peebler Fund to pay such costs."
2. 13xcept as amended by this Amendment, ail other provisions of the Agreement shall remain in full force
and effect.
IN WITNESS WHEREOF, the Parties have executed this Amendment as of the date set forth above.
