Except as amended herein, the terms and conditions of the Agreement remain in full force and effect. Except as modified herein, all terms have the same definitions as set forth in the Agreement. Each reference in the Agreement to "this Agreement", "hereunder" or words of like import shall be a reference to the Agreement as amended hereby. if any inconsistency or ambiguity exists between this Amendment and the Agreement, the terms of this Amendment shall control. 1.0 AMENDMENTS 1.1 Subject to the payment terms herein, TriTech shall develop, Deliver and Install at Client's facilities the additional Interface specified in Schedule A. The Agreement (including the licenses therein) is hereby amended to add such Interface as TriTech Software. 1.2 TriTech shall provide Software Maintenance and Support for such Interface as specified in Schedule A. The first year of Software Maintenance and Support shall commence on Installation of the Interface and the fee therefor shall be prorated to Client's current support renewal anniversary date for the TriTech Software, 1.3 The license and Maintenance and Support fees for the Interface shall be as set forth in Schedule A, payable as provided therein. 1.4 This Amendment does not include the following items, which will be provided by Client or subject to additional charges by TriTech, as the case may be: (a) Electrical work (including but not limited to outlets and generator), (b) Cabling (including but not limited to power, network, and interface cabling), network/communications (including but not limited to WAN, telephone or ISDN), or ongoing network/communications charges associated with installation, operation or support of the Interface or the CAD System, (c) Configuration and/or programming of network, routers, switches, bridges, paging systems, 911, AVL, MST, or any other ancillary systems that the TriTech Software may be interfaced with, (d) Consoles, furniture or fixtures, including but not limited to modifications necessary to install equipment associated with the Interface into existing consoles, furniture of facilities, or Santa Ana Shins amendment 2/14/2000 (8�—) 546-7792 p.3 (e) shipping, travel related installation or support costs, per diem, or any Client requests for work or items outside the scope of this Amendment, including but not limited to custom software. 1.5 Certification of Non -Discrimination .
