1. Authorize the City Manager and Clerk of the Council to award and execute a contract to
Metro Builders & Engineers Group, Ltd., the lowest responsive bidder, in accordance with the
bid in the amount of $448,339.60 and the Additive Alternate Two of $20,300, for a contract
total of $468,639.60, for the Santa Ana Stadium Structural Concrete Repairs, subject to
nonsubstantive changes approved by the City Manager and the City Attorney.
2. Approve the Project Cost Analysis for a total estimated project delivery cost of $689,300,
which includes the contract base bid amount, administration, inspection and testing, and a
contractual contingency of $130,992, subject to non - substantive changes approved by the
City Manager and City Attorney.
DISCUSSION
The Santa Ana Stadium was constructed in 1963. Due to aging and weathering, the concrete
structure at various locations has cracked and broken off, exposing the reinforcing steel, and
causing it to become corroded. In addition, the protective fencing adjacent to lateral seating
areas is damaged and rusted at various sections (Exhibit 1). The recommended actions would
support the City's effort to enhance the overall safety of the stadium by repairing the concrete
structure and steps, and replacing existing fence with new galvanized steel.
A Notice Inviting Bids was advertised on November 13 and 18, 2015, and bids were opened on
December 1, 2015. The following is a summary of the bid invitations made and the bids received:

Six bids were received and considered responsive, with Metro Builders & Engineers Group, Ltd.
submitting the lowest responsive bid. The $448,339.60 bid is comparable to the engineer's
estimate of $500,000. Based on the bids received, staff recommends award of this contract to
Metro Builders & Engineers Group, Ltd.
The bid package was divided to provide a base bid for the most essential work required to
enhance safety with an additive alternative bid that, when combined with the base bid, would also
improve the safety of the fencing. Since there is sufficient project funding for the entire scope of
work, staff recommends awarding a construction contract for the base bid of $448,339.60 plus the
Additive Alternate Two bid of $20,300, for a total contract amount of $468,639.60. The
construction contract incorporates the low bid and is ready for approval (Exhibit 2).
STRATEGIC PLAN ALIGNMENT
Approval of this item supports the City's efforts to meet Goal #6 - Community Facilities &
Infrastructure, Objective #1 (establish and maintain a Community Investment Plan for all City
assets), Strategy B (equitably maintain existing streets and associated assets in a state of good
repair so they are clean, safe and aesthetically pleasing for all users) and Strategy G (develop
and implement the City's Capital Improvement Program in coordination with the Community
Investment and Deferred Maintenance Plan.)
ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the recommended actions are
exempt from further review. Categorical Exemption Environmental Review No. 2015 -111 was
filed for these projects.

FISCAL IMPACT
The estimated total delivery cost of the project is $689,300, which includes construction, contract
administration, inspection and testing, and contingencies (Exhibit 3). Funding is available in the
Stadium Structural Concrete project (No. 16 -2656) in the FY 2015 -2016 Park Improvements
District 2 In -Lieu Development account (No. 31213261- 66220) for the amount of $510,082, and
the FY 2015 -2016 Capital Outlay and Cell Tower account (05113263- 66220) in the amount of
$179,218.

SANTA ANA STADIUM STRUCTURAL. CONCRETE REPAIR
This CONSTRUCTION CONTRACT is made and entered into this 19 day of January 2016, by
and between the CITY OF SANTA ANA, CALIFORNIA, a charter city and municipal
corporation organized and existing under the Constitution and laws of the State of California,
hereinafter referred to as "CITY" and Metro Builders & Engineers Group, Ltd., hereinafter
referred to as "CONTRACTOR ".
WITNESSETH:
The CITY and the CONTRACTOR, for the consideration hereinafter named, mutually agree as
follows:
CONTRACTOR agrees to perform all the work and furnish all the materials at its own cost
and expense necessary to construct and complete in a good and workmanlike manner and to
the satisfaction of the City Engineer of the CITY, the Santa Ana Stadium Structural Concrete
Repair, hereinafter referred to as the "Work of Improvement ", identified in and in accordance
with the Contract Documents prepared by the City's Public Works Agency and approved by
the City Council.
2. The complete Construction Contract consists of the "Contract Documents," as defined by the
Standard Specifications for Public Works Construction and which include the following:
• Notice Inviting Bids
• Information to Bidders
• Bid Proposal
• Bid Bond
• Contract Form
• Contract Bonds
• General Provisions
• Special Provisions
• Project Plans
• Appendices
In case of conflict between the Contract Documents, the precedence of documents shall be as
established in the Standard Specifications for Public Works Construction.
3. CITY agrees to pay and CONTRACTOR agrees to accept in full payment to complete the
Work of Improvement the sum total amount not to exceed $448,339.60, as set forth and
identified in the BID PROPOSAL, which is attached hereto and incorporated herein as
Exhibit "A ". The BID PROPOSAL contains a schedule of unit price(s) or lump sum(s)
based on approximate quantities only, and the City does not expressly or by implication
agree that the actual amount of work will correspond therewith, but reserves the right to
increase or decrease the amomit of any class or portion of the work or to omit portions of the
work as may be deemed necessary or advisable.

4. CONTRACTOR agrees to complete the Work of Improvement within the time specified in
the Time for Completion of Improvements section of the BID PROPOSAL (Exhibit "A ")
including commencing construction within the timeframe therein specified after issuance of a
Notice to Proceed.
5, The CONTRACTOR will pay, and will require all subcontractors to pay, all employees on
the Work of Improvement a salary or wage at least equal to the prevailing salary or wage
established for such work as set forth in the wage determinations for this work in accordance
with applicable State and Federal law.
6. CONTRACTOR shall, after award of this Contract, furnish two bonds to be approved by the
CITY, one in the amount of One Hundred Percent (100 %) of the Contract price, to guarantee
the faithful performance of the work (Performance Bond), and one in the amount of One
Hundred Percent (100 %) of the Contract price to guarantee payment of all claims for labor
and materials furnished (Payment Bond). This Contract shall not become effective until such
bonds are supplied to and approved by the CITY. CONTRACTOR shall, prior to the release
of the perfonnance and payment bonds or the retention payment, furnish a warranty
performance and payment bond equal to at least ten (10 %) percent of the final Contract price
or $1,000, whichever is greater (Warranty Bond),
7. CONTRACTOR shall, upon project completion as a condition of project acceptance, furnish
a Warranty Payment and Performance bond to be approved by the CITY, in the amount of
Twenty -Five Percent (25 %) of the Contract price, to warrant the work done under said
Contract Agreement against material or quality defects for a period of one year after
acceptance by the AGENCY.

Insurance and Worker's Compensation Insurance as outlined in the General Provisions, to be
approved by the CITY. //

the right to award the Base Bid, and any, all, or none of the add - alternate bid items.

t This bid item is considered a Specialty Item per Section 2 -3.2 of the Standard Specifications.
TIME FOR COMPLETION OF IMPROVEMENTS AND LIQUIDATED DAMAGES
The undersigned bidder hereby proposes to complete the Work for the total base bid amount
shown above, within Sixty (60) working days for Phase I and Phase II after issuance of the
Notice to Proceed. Immediately after contract award, contractor must be prepared to submit
all required documents, structural calcs, and fabrication submittals. Preconstruction meeting
shall tape place one week after Council award on January 19, 2016. The contractor shall
commence construction on or before February 8, 2016.
Phase I: Contractor shall complete all work on the west side of the stadium within the first 30
working days. Liquidated damages shall be $1,000 each day if not completed after the first 30
working days.
Phase II: Contractor shall complete work on the east side of the stadium within 30 workings
days after Phase I has been completed or sooner if Phase I has been completed before its 30
working days requirement. Liquidated damages shall be $1,000 each day if not completed after
the last 30 working days. Deadline for completing all work shall be May 20, 2016.
The liquidated damages amount in lieu of the amount specified in Subsection 6 -9 of the
Standard Specifications shall be $1,000 per calendar day after the Final Completion of the 60
working days, including Bid Alternative(s) if awarded, as specified herein for contractor to
achieve Final Completion of the entire work.

BIDDER'S STATEMENT
BIDDER understands and agrees that this Bid Proposal, Contract Documents and subsequent
Construction Contract Agreement shall constitute the entire agreement between BIDDER and
the AGENCY only after it has been accepted by the City Council, endorsed by the Clerk of the
Council with her signature and official seal noting hereon the action of approval of the Council,
signed by the Public Works Agency Executive Director or his /her duly authorized agent, and
signed by the City Attorney, denoting his approval of the form of this document, and its

accompanying this proposal shall become the property of the AGENCY and shall be considered

PREVAILING WAGE COMPLIANCE AND MONITORING STATEMENT
Contractor is aware of the requirements of California Labor Code Section 1720, et seq., as well
as California Code of Regulations, Title 8, Section 16,000, et seq., ( "Prevailing Wage Laws "),
which require the payment of prevailing wage rates and the performance of other
requirements on "public works" and "maintenance" projects. Since the services are being
performed as part of an applicable "public works" or "maintenance" project, as defined by the
Prevailing Wage Laws, and since the total compensation is $1,000 or more, Contractor agrees
to fully comply with such Prevailing Wage Laws.
City shall provide Contractor with a copy of the prevailing rates of per diem wages in effect at
the commencement of this Agreement. Contractor shall make copies of the prevailing rates of
per diem wages for each craft, classification or type of worker needed to execute the services
available to interested parties upon request, and shall post copies at the Contractor's principal
place of business and at the project site.
Contractor shall defend, indemnify and hold the City, its elected officials, officers, employees
and agents free and harmless from any claim or liability arising out of any failure or alleged
failure to comply with the Prevailing Wage Laws.
