The Planning Commission made no changes to the attached staff report (Exhibit A). The City's Housing Authority is proposing to rezone three parcels of land that are located within the Transit Zoning Code boundaries from Urban Neighborhood -2 (SD- 841UN -2) to Open Space (SD- 84 /08). The purpose of the rezoning is to facilitate the future construction of a public park within the central section of the City. DISCUSSION Request of the Applicant The City of Santa Ana is requesting approval of an amendment application in order to rezone three properties located at 710, 714 and 720 East Sixth Street from Specific Development No. 84/Transit Zoning Code (SD -84) with a subzone designation of Urban Neighborhood -2 (SD- 84/UN -2) to a subzone designation of Open Space (SD- 84/OS) in order to facilitate the future construction of a public park. Project Location and Site Description The subject site consists of three contiguous properties located at 710, 714 and 720 East Sixth Street that are located within the Transit Zoning Code project area. These parcels, which will require a voluntary lot merger when the proposed park is submitted for approval, are rectangular in shape and total approximately 0.43 acres. Each parcel is currently developed with a vacant, single - family residence. Although all three residences were built prior to the 1940's, none of them are listed on the City's Register of Historical Properties. These parcels were acquired by the former Redevelopment Agency several years ago and were originally identified as potential sites for new housing. With the dissolution of redevelopment agencies statewide, the parcels were transferred to the Housing Authority as allowed under State law. The site is surrounded by multiple - family residential uses to the north, south and west, and by Garfield Elementary School to the east (Exhibits 1, 2 and 3). The parcels have a General Plan land use designation of Urban Neighborhood (UN), which allows for residential and open space uses and is EXHIBIT A 75B -3 Amendment Application No. 2015 -02 December 14, 2015 Page 2 zoned Specific Development No. 84 (SD- 84/Transit Zoning Code), with a subzone designation of Urban Neighborhood -2. The zoning designation is not consistent with an open space use; however, approval of the amendment application will make the future park use consistent with the proposed zoning designation (Exhibit 4). Proiect ®escription The City of Santa Ana is proposing to rezone three parcels of land located within the Transit Zoning Code boundaries from Urban Neighborhood -2 (SD- 84/UN -2) to Open Space (SD- 84 /OS). No development is proposed on the parcels at this time by the City; however, future plans for the site consist of the construction of a public park. On November 17, 2015, the City Council approved a request by the Community Development and Parks, Recreation and Community Services Agencies to begin the administrative process for the Housing Authority to sell the properties to the City. This action will allow the properties to be converted from residential uses to a future park use. Proiect Anaiysis In 2010, the City Council adopted Specific Development No. 84 (SD -84), which established the Transit Zoning Code specific plan for the Downtown and Central areas of the City. Within the SD -84 is a series of subzones that established detailed regulations for development and land uses within the project boundaries, including subzones dedicated to uses such as mixed -use and open space. When the plan was adopted, the plan considered the development of parks within the project boundaries in an effort to provide much needed open space in one of the most urban areas of the City. However, since the three subject properties each contained a residential unit, the properties were zoned to be Urban Neighborhood -2, which was consistent with the existing single - family land uses. City staff has been working with the National Park Service (NPS) to identify additional park acreage in the City in order to mitigate the loss of 2.6 acres of park land at Centennial Park, which is being used by the Rancho Santiago Community College District (RSCCD) as their adult education campus. The subject parcels, in conjunction with an additional 1.09 acre parcel at Raitt and Myrtle Streets, will address the concerns of the NIPS. Staff is recommending approval of the zone change for several reasons. First, the rezoning of the site will ensure there is consistency between the Zoning and General Plan land use designations. This consistency will give the property owner clear direction in regards to potential land uses and development opportunities for the property. Second, the site is physically suitable as an open space use. The site is within a neighborhood that is deficient in open space, given the population density in the area. The use of the properties as a future public park will provide an additional recreational opportunity to residents in the immediate area. Third, the extensive rehabilitation that is needed to 75B -4 Amendment Application No. 2015 -02 December 14, 2015 Page 3 make the units habitable would be cost prohibitive. Given the limited resources available for the rehabilitation of residential properties, the resources needed for these units could be more effectively used on other projects. Finally, the vacant units have resulted in numerous impacts that have adversely affected the surrounding neighborhood. Removal of these units will minimize the code enforcement actions that have resulted from these vacant structures and will allow a park use that will benefit the community. Public Notification The project site is located within the Lacy Neighborhood Association and is adjacent to the Logan and French Park Neighborhood Associations, The Presidents of these neighborhood associations were notified by mail 10 days prior to this public hearing. The project site itself was posted with a notice advertising this public hearing, a notice was published in the Orange County Reporter and mailed notices were sent to surrounding property owners and tenants within 500 feet of the project site, as well as concerned citizens listed on the Permanent Notification List. At the time of this printing, no correspondence, either written or electronic, has been received from any members of the public. CEQA Analysis In accordance with the California Environmental Quality Act, the proposed project is exempt from further review pursuant to Section 15061(b)(3), which is a general rule exemption applicable to projects where it is certain that the project will have no possibility of having a significant effect on the environment. Therefore, General Rule Exemption /Environmental Review No. 2015 -115 will be filed for this project. Strategic Plan Alignment Approval of this item supports the City "s efforts to meet Goal No. 5 Community Health, Livability, Engagement and Sustainability, Objective No. 4 (support the design and construction of parks to provide increased open space and opportunities for recreation throughout the City). Conclusion Based on the analysis provided within this report, staff recommends that the Planning Commission recommend that the City Council approve Amendment Application No. 2015 -02. NS -XXX AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REZONING PROPERTIES LOCATED AT 710, 714 AND 720 EAST SIXTH STREET FROM SPECIFIC DEVELOPMENT NO. 84/URBAN NEIGHBORHOOD -2 TO SPECIFIC DEVELOPMENT NO. 84/OPEN SPACE (AA NO. 2015 -02) THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Santa Ana does hereby find, determine and declare as follows: A. Amendment Application No. 2015 -02 has been filed with the City of Santa Ana to change the zoning district designation of certain real property located at 710, 714 and 720 East Sixth Street from Urban Neighborhood -2 to Open Space of the Specific Development No. 84 (SD -84) zoning district. The new zoning designation would allow the development of a public park to be built on the 0.43 acre parcels of land. B. The Planning Commission of the City of Santa Ana held a duly noticed public hearing on December 14, 2015, on Amendment Application No. 2015 -02 and recommended that the City Council adopt an ordinance approving Amendment Application No. 2015 -02, which is consistent with the General Plan land use designation for the parcels. C. This Council, prior to taking action on this ordinance, held a duly noticed public hearing on January 19, 2016. D. The City Council also adopts as findings all facts presented in the Request for Council Action dated January 19, 2016 accompanying this matter. E. For these reasons, and each of them, Amendment Application No. 2015 -02 is hereby found and determined to be consistent with the General Plan of the City of Santa Ana and otherwise justified by the public necessity, convenience, and general welfare. 75B -11 LS 12.7.15 Section 2. The City Council has reviewed and considered the information contained in the CEQA analysis prepared with respect to this project. The City Council has, as a result of its consideration of the record as a whole and the evidence presented at the hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act (CEQA) and the State CEQA Guidelines, General Rule Exemption No. 2015 -115 meets all requirements of CEQA. Section 3. The real properties located at 710, 714 and 720 East Sixth Street in Santa Ana are hereby reclassified from Specific Development No. 84 (SD -84) /Urban Neighborhood -2 to Specific Development No. 84 (SD -84) /Open Space. An amended Sectional District Map, showing the above described change in use district designation, is hereby approved and attached hereto as Exhibit "A" and incorporated by this reference as though fully set forth herein. Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
