CODE OF CONDUCT AND ETHICS
AD HOC COUNCIL COMMITTEE
JUNE 7, 2012
Meeting convened at Police Community Room, 60 Civic Center Plaza, Room 831,
Santa Ana, CA at 6:25 p.m.
In attendance were Committee Members Sal Tinajero (Chair) and Vince Sarmiento and
Staff members Jose Sandoval (Legal Counsel) and Maria D. Huizar (Recording
Secretary)
AGENDA ITEMS
1. DISCUSSION AND CONSIDERATION OF SUNSHINE ORDINANCE
Representatives from SACReD presented a proposed Sunshine Ordinance and
outlined perceived benefits to the community.
Staff presented matrix with staff analysis and practical implications on proposed
policy; noted that it was an expansion of the Brown Act, Public Records Act and
other existing State laws and regulations.
The following residents spoke on the matter:
• Elizabeth Brogdon, student at California State University, Fullerton,
commented on need for community involvement in decision making; need for
oversight commission.
• Tixoc Ventura, information needs to be accessible before decisions made;
proposed library closure should have public input.
• Flor Garcia, opined that sunshine ordinance would improve health and
obesity rates; need to improve public participation and open calendars for
transparency purposes.
• Lara Montagne, representing the Grain Project, concerned that Station
District project did not include public input or outreach efforts.
• Adriana Reza, student at Cal. State Fullerton, proposed sunshine ordinance
would deliver information on health related issues.
• Jeannette Rubio, interested in improving public information and notification
process.
• Albert Castillo, opined that Renaissance Plan approved as Station District;
suggested a community oversight committee to discuss open space and
housing issues.
• Jeff Dickman, concerned with development process; suggest easy to read
and understood be available to the public; set policy and guidelines for future
leaders.

• Eduardo Garcia, member of SEIU -USWW, supports sunshine ordinance;
opined that ordinance would allow for better job opportunities.
• Christian Abasto, Director of Litigation at The Public Law Center, drafted
proposed sunshine ordinance; open to discuss ordinance that serves their
purpose and that of the City's.
• Carolina Sarmiento, supports proposed sunshine ordinance; opined that
planning process difficult to follow; grass root effort used to develop proposed
ordinance; formalize in writing some of the existing process requested in
sunshine ordinance.
• Glen Stroud, support sunshine ordinance; suggest that Memorandums of
Understanding documents be readily available to the public since labor costs
are city's largest expense; need for oversight committee such as the Grand
Jury and penalties are required.
• Dwight Smith, Catholic Worker, opined that homeless do not have access to
public library computers to access their government because they do not
have an address; request staff review possible discrimination issues.
• Chair Tinajero indicated that staff would look into allegations.
• Thanked participants for interest in their community; city council to
consider Sunshine Ordinance.
• Chair Tinajero motion to schedule matter for City Council
consideration, seconded by Committee Member Sarmiento.
• Committee member Sarmiento commended staff for efforts in
analyzing ordinance; staff to further evaluate ordinance; objective is to
improve on state's minimum requirements, but not be cost prohibitive;
transparency and openness highly regarded.
