MINUTES MOTION: Approve the minutes of the regular meeting of April 11, 2016. * " END OF CONSENT CALENDAR " BUSINESS CALENDAR PROJECTS): - No disclosures made. *TELECONFERENCE - Commissioner Eric Alderete participated in the meeting via teleconference from The Westin Jersey City Newport Lobby, 479 Washington Boulevard, Jersey City, NJ 07310. All Brown Act requirements were met for this occurrence. PLANNING COMMISSION MINUTES 1 APRIL 25, 2016 PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO. 2016-12 (Applicant: 7 -Eleven, 2626 North Bristol Street, Unit B) Legal notice published in the Orange County Reporter on April 15, 2016 and notices mailed April 15, 2016. Applicant submitted a written request asking that the item be pulled and continued to a date uncertain. 2. CONDITIONAL USE PERMIT NO. 2016-13 AND VARIANCE NO. 2016-03 (Applicant: Raul Balderrama Banquet Facility, 1002 East Seventeenth Street, Unit M) Legal notice published in the Orange County Reporter on April 15, 2016 and notices mailed April 15, 2016. Ricardo Garibay, property owner, and Richard Garcia, project manager, spoke requesting that the item be continued to the May 9, 2016 meeting. MOTION: Continue item to the May 9, 2016 meeting at the request of the applicant. CONDITIONAL USE PERMIT NO. 2016-14 (Applicant. Restaurant Acapulco, 2429 West McFadden Avenue, Unit 106) Legal notice published in the Orange County Reporter on April 15, 2016 and notices mailed April 15, 2016. A project overview was provided by Pamela Guerra, Planning Technician. Chairman Gartner opened the public hearing. Leon Jacobs, representing three neighborhood associations, spoke in opposition of the project noting concern that the security guard leaves at 10:00 p.m. Duke Yum, property owner, spoke in support of the project and noted he is willing to extend hours of security guard until the closing of the restaurant. Ha Nguyen, applicant, was available to answer questions and spoke in support of the project. There were no other speakers and the hearing was closed. MOTION: Adopt a resolution approving Conditional Use Permit No. 2016-14 as conditioned with the added condition No. 3 to reauire security guard on premises from 12:00 noon until closing of restaurant. TENTATIVE TRACT MAP NO. 2016-01 (Applicant: Takenaga Trust, 1406 North Harbor Boulevard) Legal notice published in the Orange County Reporter on April 15, 2016 and notices mailed April 15, 2016. A project overview was provided by Ali Pezeshkpour, Senior Planner. Chairman Gartner opened the public hearing. Written communication received from Jack Noenickx in opposition of the project. Kim Prijatel, applicant, was available to answer questions and spoke in support of the project. Commission discussion ensued on the design. There were no other speakers and the hearing was closed. MOTION: Adopt a resolution approving Tentative Tract Map No. 2016-01 as conditioned. ZONING CODE UPDATE Item continued to the May 9, 2016 meeting. BUSINESS CALENDAR 6. CITY POLICY ON COMMISSIONER EMAIL ADDRESSES Candida Neal noted at the request of Commission, item was placed on agenda for discussion and direction. Commission discussion ensued on the creation of city email addresses for Commissioners. MOTION: Request staff explore use of city email addresses for Planning Commission members. MOTION: McLoughlin SECOND: Bacerra VOTE: AYES: Bacerra, McLoughlin, Verino (3) NOES: Alderete, Bauer, Gartner, Mill (4) ABSTAIN: None (0) ABSENT: None (0) Motion failed by 3-4 vote. PLANNING COMMISSION MINUTES 3 APRIL 25, 2016 SUBSTITUTE MOTION: Adopt a policy outlining a consistent use of emails and each Commissioner setup a Gmail account or similar and utilize format that is consistent. MOTION: Bauer Motion died due to the lack of a second. ABSENCES 7. EXCUSED ABSENCES - No absences COMMENTS 8. PLANNING MANAGER UPDATES Candida Neal • Introduced new part-time Planning Technician Pamela Guerra who is a student studying for her masters in Urban Planning at UCI. • Announced the promotion of Ricardo Soto to Associate Planner. • Announced the first General Plan and Zoning Ordinance Subcommittee meeting was held to review the Massage Ordinance revisions and will present to the Commission at the next meeting. 9. PLANNING COMMISSION MEMBER COMMENTS Commissioner Verino • Inquired on the status of the closed Happy Hands Carwash located at 17th & Baker adding the gated property is deteriorating. Staff answered it is in the second round of plan check for the renovation to an express car wash. • Welcomed Pamela Guerra adding the great job on her first presentation. Chairman Gartner • Echoed Commissioner Verino's sentiments and welcomed Pamela Guerra and congratulated Ricardo Soto.
