PLANNING COMMISSION MINUTES 1 MAY 9, 2016 PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO. 2016-13 AND VARIANCE NO. 2016-03 (Applicant: Raul Balderrama Banquet Facility, 1002 East Seventeenth Street, Unit M) Legal notice published in the Orange County Reporter on April 29, 2016 and notices mailed April 29, 2016. Item continued from April 25, 2016 to May 9, 2016 by a 7:0 vote. Ali Pezeshkpour, Senior Planner, noted applicant is requesting to continue item indefinitely. Commissioners agreed to proceed with public hearing to hear testimony from members of the public in attendance. A project overview was provided by Mr. Pezeshkpour. Chairman Gartner opened the public hearing. Teresa Arellano, Joe Thompson, Richard Garcia and Ricardo Garibay spoke in support of the project. Abelina Velazquez, Walter Martinez, Tony Palomo, Robert Palomo, Benigno Cervantes and Lorena Rodriguez spoke in opposition to the project citing impacted parking, loud music and impaired guests. Raul Balderrama, applicant, answered questions and spoke in support of the project. There were no other speakers on the matter and the hearing was closed. Commission discussion ensued on impacts of the business on the neighborhood, code enforcement efforts and police calls for service. MOTION: 1. Adopt a resolution denying Conditional Use Permit No. 2016-13. 2. Adopt a resolution denying Variance No. 2016-03. A project overview was provided by Ali Pezeshkpour, Senior Planner. Chairman Gartner opened the public hearing. Chris Maffris, applicant, answered questions and spoke in support of the project. Written communication from Tim Rush of the Wilshire Square Neighborhood Association voiced opposition to the project. There were no other speakers on the matter and the hearing was closed. ZONING CODE UPDATE Item continued from April 11, 2016 to April 25, 2016; and from April 25, 2016 to May 9, 2016 to the May 9, 2016 meeting. Planning Manager Candida Neal provided a brief overview on the Zoning Code Updates staff will be undertaking in the next fiscal year. The first update is the Massage Ordinance to be in compliance with the state's current legislation. The second is an update to the wireless communication facilities regulation which the state has changed methodology and developed strict processing time frames. The City Council directed staff to look at the Metro East Mixed -Use Overlay Zone for opportunities for a mix of commercial and residential uses along First Street to the west; in conjunction staff will be looking at parking ordinances as part of Metro East Mixed -Use Overlay Zone and will solicit for proposals for innovative parking solutions and ideas and will focus on using city-wide. Finally Council directed staff to look at development processes and standards to make the development process more business friendly. ABSENCES 6.
