RESOLUTION NO. 2016-31
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA APPROVING SITE PLAN
REVIEW NO. 2016-02 AS CONDITIONED TO ALLOW AN
EXPANSION AND EXTERIOR REMODEL AT THE
PROPERTY LOCATED AT 1400 SOUTH DAN GURNEY
DRIVE
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby finds,
determines and declares as follows:
A. Applicant is requesting approval of Site Plan Review No. 2016-02 to allow
an expansion and remodel at an automobile dealership building at the
property located at 1400 South Dan Gurney Drive.
B. Santa Ana Municipal Code Section 41-593.5(c) requires a review by the
Planning Commission of all plans within a specific development (SD) plan
area to ensure the project is in conformity with the Specific Plan.
C. Site Plan Review No. 2016-02 came before the Planning Commission of
the City of Santa Ana on July 25, 2016.
D. The project is in compliance with all applicable development standards
outlined within the Specific Development Plan (SD -60).
E. In accordance with the California Environmental Quality Act (CEQA), the
recommendation is exempt from further review pursuant to Section 15303.
This Class 3 exemption applies to projects consisting of construction and
location of limited numbers of new, small facilities, or structures of up to
10,000 square feet in floor area insofar as the project and site meet the
following criteria: that the project site is zoned for such use, that the
project note involve the use of significant amounts of hazardous
substances where all necessary public services and facilities are
available, and the surrounding area is not environmentally sensitive.
Moreover, the project and its location meet the test for exceptions as
outlined in Section 15300.2 of the CEQA guidelines; the project site is not
located in an environmentally sensitive area and will not impact an
environmental resource of hazardous or critical concern. Based on these
criteria and on staff's analysis, Categorical Exemption Environmental
Review No. 2015-95 will be filed for this project.

Section 2. The applicant agrees to indemnify, hold harmless, and defend the
City of Santa Ana, its officials, officers, agents, and employees, from any and all liability,
claims, actions or proceedings that may be brought arising out of its approval of this
project, and any approvals associated with the project, including, without limitation, any
environmental review or approval, except to the extent caused by the sole negligence of
the City of Santa Ana.
Section 3. The Planning Commission of the City of Santa Ana hereby approves
Site Plan Review No. 2016-02 as conditioned in Exhibit "A" attached hereto and
incorporated herein. This decision is based upon the evidence submitted at the
abovesaid hearing, which includes, but is not limited to: the Request for Planning
Commission Action dated July 25, 2016, and exhibits attached thereto; and, the public
testimony, written and oral, all of which are incorporated herein by this reference.

EXHIBIT A
Conditions for Approval
Site Plan Review No. 2016-02 is approved subject to compliance, to the reasonable
satisfaction of the Planning Manager, with all applicable sections of the Santa Ana
Municipal Code, the California Administrative Code, the California Building Standards
Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed belowrip or to
exercising the rights conferred by this site plan review approval.
The applicant must remain in compliance with all conditions listed below throughout the
life of the site plan review approval. Failure to comply with each and every condition may
result in the revocation of the site plan review approval.
A. Planning Division
1. All improvements to the project shall be consistent with the approvals
granted per Development Project No. 2015-52.
2. Prior to issuance of Building permits, the applicant shall receive final
approval of elevations, building materials and finishes, and landscape and
hardscape materials by the Santa Ana Auto Mall Architectural Review E
Board (ARB) if the ARB requests a review of the project.
3. Any amendment to this site plan review approval must be submitted to the
Planning Division for review. At that time, staff will determine if
administrative relief is available or if the project must be formally
amended.
