Vice Chair Bauer disclosed communication with Pam Sapetto on Agenda Item No. 4. AGENDA ITEM TAKEN OUT OF ORDER PUBLIC HEARINGS 4. ZONING ORDINANCE AMENDMENT NO. 2016-02 (Applicant: Heritage Village OC LCC — Housing Opportunity Ordinance) Legal notice published in the Orange County Register on July 15, 2016 and notices mailed July 14, 2016. A project overview was provided by Hassan Haghani, Executive Director. Vice Chair Bauer opened the public hearing. The following speakers spoke on the proposed amendment: • Marina Ramirez, representing NeighborWorks O.C., spoke in opposition • Luis Sarmiento, representing Centro Cultural de Mexico, spoke in opposition • Ana Urzua, representing S.A. Building Healthy Communities, spoke in opposition • Joese Hernandez, representing OC Communities Organized for Responsible Development (OCCORD), spoke in opposition • Cesar Covarrubias, representing The Kennedy Commission, spoke in opposition • Lynnette Guzman, resident & representing Santa Ana Active Streets Coalition (SAAS), spoke in opposition • Nancy Mejia, representing Latino Health Access, spoke in opposition • Araceli Robles, resident, spoke in opposition • Rosaisela Lopez, representing OCCORD, spoke in opposition • Pamela Sapetto, representing applicant, spoke in support noted fee will remain the same and be paid. Commission discussion ensued on the inclusionary housing in -lieu fees and phased payments, phasing of construction and the wording of the current ordinance. PLANNING COMMISSION MINUTES 2 JULY 25, 2016 MOTION: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 2016-02. MOTION: Gartner SECOND: Bacerra VOTE: AYES: Bacerra, Gartner (2) NOES: Bauer, McLoughlin (2) ABSTAIN: None (0) ABSENT: Alderete, Verino (2) The Planning Commission split by a vote of 2:2 (Chairperson Verino & Commissioner Alderete absent) on the motion to recommend approval of amendment, thus creating an impasse. Candida Neal noted in the event of a non -decision, staff will prepare staff report to Council that will present the positions of those supporting the amendment and those voting against it. The item will be presented to the City Council without a recommendation from the Planning Commission. CONTINUED - BUSINESS CALENDAR 1. SITE PLAN REVIEW NO. 2016-02 (Applicant: John Garcia, Volvo of Orange County - 1400 South Dan Gurney Drive) MOTION: Adopt a resolution approving Site Plan Review No. 2016-02 as conditioned. A project overview was provided by Hally Soboleske, Senior Planner. Vice Chair Bauer opened the public hearing. There were no speakers and the hearing was closed. PLANNING COMMISSION MEMBER COMMENTS Commissioner McLoughlin • Requested a recap of projects approved the past year with a status update on each project. Mr. Haghani noted staff will periodically provide a memo with updates with Commission binders. PLANNING COMMISSION MINUTES 4 JULY 25, 2016 Commissioner Gartner • Remarked Vice Chairman Bauer did a great job running the meeting. • Noted he is looking forward to the August vacation. Vice Chairman Bauer • Thanked everyone for bearing with him and noted appreciation for their assistance.
