THIS AGREEMENT made and entered into this 22 day of
, 1970, by and between the CITY OF SANTA ANA, a
municipal corporation, and GREAT WESTERN RECLAMATION, INC. , a
corporation.
Specific reference is hereby made to the contract entered
into by and between the parties hereto on the 12th day of August,
1963, which consisted of two pages and twelve pages of specifi-
cations, as amended by the contract entered into by and between
the parties hereto on the 24th day of March , 1969, which
consisted of one page. Said contract is hereby amended in the
following particulars.
1. Section 2 (f) of the specifications is hereby amended
in the following particulars:
At lines 8 and 9 thereof the words "sixty pounds" are
deleted and in their place the words and figure "fifty (50)
pounds" are substituted.
2. Section 2 (h) of the specifications is hereby amended
in the following particulars:
The first paragraph thereof is deleted.
The second paragraph thereof is amended to read as
follows :
"The Contractor will collect all refuse from the
commercial and residential areas of the City at least
once each week; and, in addition, will provide more
frequent or special service at uniform rates for such
users as may require such additional service. "

3. Section 2 (i) of the specifications is hereby amended
to include Memorial Day as a holiday for the purpose of this
contract.
4. That the provisions of this contract amendment shall
take effect on November 1, 1970.

Subject: PROPOSED CHANGES IN REFUSE COLLECTION RULES AND REGULATIONS
On November 1, 1963, Great Western Reclamation, Inc. , began a seven-year contract for the
collection and disposal of refuse within the City of Santa Ana. Just previous to that
time, the City Council received bids, and the contract was awarded to the lowest bidder.
In reviewing the experiences of these past six years, as a general conclusion, we believe
that the contractor has provided adequate service. Our administrative costs have been
minimal, and with the suggested changes contained in this report, we feel that both the
service and administration can be made more effective. At a cost of $1.00 per month per
household, Santa Ana has the lowest charge for refuse collection of any jurisdiction in
Orange County. There are presently 36,500 refuse collection stops in this City. Last year,
the City Council authorized an extension of the contract for an additional four-year period
--making the new expiration date October31, 1974. This was done so that the contractor
could make a large capital investment in new equipment.
The attached sheet listing the possible changes in refuse collection rules and regulations
were mailed on July 7 to a number of organizations within the City and to the press. In
our letter of transmittal we asked for the comments of the organizations since some of the
changes would be of concern to local businesses. We also offered to have a representative
from the Public Works Department attend a meeting of each group to answer questions and to
discuss the changes in more detail. These letters were sent to the following organizations:

Letters favoring the changes were received from the Chamber of Commerce, the City Center
Association, L.I.S.A. , and the Industrial Development Association. A letter was also
received from the South Main Improvement Association stating their opposition to the change
from the present schedule of daily collection in the commercial map area to the proposed
once-a-week collection. A story in The Register gave these proposals city-wide publicity
early in July (copy attached) .
CHANGE 1 - Amend the dontract with Great Western to provide that all refuse in the City
will be collected at least once each week on a regular schedule and to provide
that any commercial users who require or desire to have more frequent collection
may contract with the collector for the extra service at uniform rates.
This will delete the special treatment for daily pick-up afforded certain portions of the
commercial areas since this contract was initiated, and provide uniform treatment for all
commercial areas of the City. Section 2(h) of the contract requires daily collection from
certain commercial areas of the City as indicated on the Exhibit Map, a copy of which is

attached to this report. This area primarily includes the downtown portion of Santa Ana
from First to Fifth, and from Birch to French along with other long-strip commercial areas
such as Main Street, a small portion of 17th, a large portion of Fourth, and three small
portions of Bristol. This means that the contractor has to pick up six times a week in
those marked areas, but only once a week in all other areas of the City. The Map area can
be revised on order of the Director of Public Works.
In 1966, the City went to direct billing rather than placing the cost on the property tax
rolls, and it was necessary to establish a rate schedule for people in the Map areas who
in turn would pay the City on the basis of weight of trash and frequency of pick-up. All
other commercial areas outside the Map area arranged for extra services by entering into
contracts and making payments directly to Great Western. In order to administer this
specific area so that proper charges could be made, it was necessary for the City to add
considerable staff time; a Clerk-Typist on half-time basis, a Sanitation Inspector on a
one-fourth time basis, and the Office Supervisor on a one-eighth time basis. The cost to
the City for handling this particular feature of the contract is estimated to be $9,847
a year.
We believe that all commercial areas of the City should be provided the same basic service
at the same price as any other establishment whether residential, industrial or commercial;
and that any service desired beyond this basic service, should be handled by agreement be-
tween the customer and the contractor. There would be some loss of revenue to the City
since all billing except the $1.00 per month would be transferred from the City to the
contractor. The amount of this loss is estimated at $8,784 per year. However, by eliminating
the administrative cost previously described, the City would end up with a net saving of
$1,063 per year.
There are 809 customers in the Map area that are not on container contracts. Many of these
are small businesses producing small amounts of trash. Large generators of trash would
have to pay more for refuse collection under this proposal if they were to go to container
contracts. We believe that there are only a few in this category as most businesses that
can utilize containers have already done so. Lack of storage space on the premises will
many times prevent their use. In this situation the larger users (exceeding 200 pounds
once a week) then enter into overweight or carry-out contracts with Great Western for this
extra service.
Small businesses, however, who only require once a week pick-up would not have to pay any
more than they are presently. In fact, they would be permitted to place 200 pounds of
trash each week out for pick-up, whereas the present rate schedule permits only 100 pounds
per week for the $1.00 a month charge. Municipal Code Section 16-34(a) (2) says:
"Commercial, multi-family industrial units, and others may have refuse collections more
frequently than one time per week after entering into an agreement for such special
services." We believe that the proposed change is needed for compliance with the intent
of this Code Section and to be equitable for all areas of the City.

CHANGE 2 - Reduce container and single item maximum weight limits from 60 to 50 pounds.
This will help reduce the number of back injuries to employees of the contractor; trash
collectors have the highest occupational injury rate of all industries. Many single
items have no handles or hand-holes, and are difficult to pick up. Most large containers
sold for household use will not exceed 50 pounds when fully loaded unless the material is
packed down with a considerable degree of effort on the part of the user.
CHANGE 3 - Add Memorial Day to the list of holidays.
Section 2(1) of the contract lists the holidays to be observed by the contractor and provides
that when a normal collection day falls on a holiday, the refuse will be picked up on the
day following. We recommend that Memorial Day be added to the list since it is a holiday
under the contractor's agreement with the union which would normally require him to pay
over-time rates. We have previously at the Department level given authorization to the
contractor for collection of trash on the day following Memorial Day. The agreement should
be amended in order to give legal sanction to this change. During weeks in which holidays
occur, all trash collections from the holiday to the end of the week are picked up one day
behind the regular schedule. There has been no particular difficulty with this practice.
CHANGE 4 - Prohibit the use of regular paper bags or other materials as containers which
become unusable when wet or which are easily scattered by wind or animals, and
provide for the collection of cardboard boxes used as containers.
Municipal Code Section 16-33(d) (1) provides that refuse container suitable for collection
purposes, etc. , shall be provided for by the owner or occupant of premises, and that they
must be maintained in good and sanitary condition. We feel that this provides latitude for
the citizen to provide a container of his choice and as long as it performs its function
adequately, there is no problem. We do, however, recommend that the use of paper bags or
other materials which become unusable when wet, or which are easily scattered by wind or
animals, be restricted. We do not oppose the use of cardboard boxes for initial set-out,
but feel that they should not be set back to the curb for re-use. We want to encourage
the use of properly designed paper or trash bags for the same reason that we want to
discourage ordinary paper bags or cardboard cartons. It helps keep the City clean, speeds
up collection, reduces injuries, and reduces noise. We do not believe that this will
require any changes in our present rules and regulations but wish to bring to the attention
of the City Council this particular change in enforcement which is being contemplated.
The City Attorney's office has prepared three documents which will provide for all of the
proposed changes contained in this report. These are Ordinance NS-1038, Resolution 70-81,
and an agreement to amend the existing contract with Great Western Reclamation, Inc. The
documents provide that the effective date for these changes would be November 1, 1970--
which is the end of the original seven-year contract period which was entered into 1963.

Recommendation. That the City Council approve these four proposed changes and provide for
their implementation by adopting:
a. ORDINANCE NS-1038 amending Section 16-33 of Chapter 16 of the Santa Ana Municipal Code
pertaining to refuse collection regulations.
b. RESOLUTION 70-81 amending Resolution 68-142 pertaining to refuse collection rules and
regulations.
c. AN AGREEMENT to amend the contract for refuse collection between Great Western
Reclamation, Inc. , and the City of Santa Ana.

Attached for your consideration are some possible changes in our existing
refuse collection rules and regulations which are being considered by the
staff of the Department of Public Works. We hope to review these possible
changes and make our recommendations to the City Manager by August 15.
The comments of your organization are being solicited at this early stage
because some of the changes may be of concern to local businesses and
because we would like to have the opportunity of utilizing your comments
and suggestions before we finalize our recommendations to the City Manager:
At $1. 00 per month for home-owners, Santa Ana has the lowest charge for
refuse collection in Orange County and we wish to utilize every opportunity
to improve the service and administration so that costs will remain as low
as possible.

At the July 14, 1970, board meeting of L„I.S.A., , it was moved,
seconded and carried that L<I.S,A. approve the proposed changes
in refuse collection rules and regulations for Santa Ana, as
set out in a letter from Mr. Wolford, Director of Public Works,
as follows:
Once a week collection etc. (Change 1)
Reduction of container weight to 50 pounds (Change 2)
Memorial Day added to list of holidays (Change 3)
Paper bags and cardboard boxes to be used only once (Change 4)
Elimination of 30 gallon steel drums (Change 5)
Elimination, if possible, of the use of 50 gallon-size
cardboard drum (Change 6)
The board members also were in favor of starting refuse collection
at 5 A,M. , after it was explained by John Barnes, Inspector for
the Department of Public Works, that the trucks would be on their
way to the dump at about the time children were on their way to
school and that it would also remove trucks from the freeways
• during rush hours (4 to 5 P.M. ) .
As the enclosed will indicate , we are participating in the
SUMMER CLEAN-UP CAMPAIGN and appreciate the wonderful cooperation
provided by the Great Western Reclamation_ Company in don& ting
the use of the large trash contaliners for unwanted items.
