Recitals: A. CITY and CONTRACTOR entered into that certain AGREEMENT FOR COLLECTION AND HANDLING OF SOLID WAS I'ES GENERATED, PRODUCED AND/OR ACCUMULATED IN THE CITY OF SANTA ANA, dated June 30, 1993, by which CONTRACTOR was granted the exclusive right to collect and dispose of solid waste in the City of Santa Ana (the "Agreement"). B. CITY and CONTRACTOR do now desire to amend the Agreement to modify the method for determining the number of curbside units. WHEREFORE, the parties hereto do hereby agree as follows: 1. That Section 9(a) of the Agreement is amended to read: (a) The grant of exclusiveness shall not include construction or demolition of solid waste which has accumulated and/or been generated at a temporary construction site and which is being disposed of in a roll-off container(s) or in a bin(s). Adopt an ordinance amending Chapter 16 of the Municipal Code to allow temporary construction and demolition solid waste to be collected in roll-off containers or in bins. 2 . Direct the City Attorney to prepare and authorize the Mayor and Clerk of the Council to execute an agreement with Ware Disposal and an agreement and amendment with Great Western Reclamation for collection and handling of temporary collection and demolition solid waste through the year 2002 . DISCUSSION In 1993 , the City awarded a five year agreement to Great Western Reclamation to collect and dispose of the City' s solid waste following a competitive process. That agreement included all solid waste generated in the City except temporary construction and demolition solid waste. At that time, the Council authorized staff to send a five-year notice to haulers operating in the City indicating the City' s intentions to limit the number of haulers for the collection and disposal of temporary construction and demolition solid waste at the end of the five-year period. The Council also requested that staff work with the small haulers to develop a process that would allow small haulers to continue providing roll-off services in the City. Staff met with the small haulers and representatives from the Chamber to develop a permit 14 3 0 C.S.383 Ordinance Amending Chapter 16 of the Code and Agreements for Construction and Demolition Solid Waste January 2 , 1996 process; those meetings failed to produce a permit process that was acceptable to the various participants. Based on the City' s need to recycle this sector of the waste stream to meet the 50% diversion required by state law in 2000, staff has met with Ware Disposal and with Great Western Reclamation to develop agreements for handling the City' s temporary construction and demolition waste. Currently, Chapter 16 of the City' s Municipal Code and Great Western' s agreement with the City limits other contractors to the collection of temporary construction and demolition material in roll-off containers. The proposed amendments (to the Code and to Great Western' s agreement) remove that limitation and allow contractors to collect temporary construction and demolition debris in roll-off containers or in bins provided they have an agreement with the City. These changes are proposed to guarantee the two companies the same access to the marketplace. The agreements submitted for Council approval will allow Ware Disposal and Great Western Reclamation to collect temporary construction and demolition solid waste through the year 2002 and will provide recycling of these materials beginning in July 1998 (eighteen months before the compliance period begins for the year 2000. ) In addition, both companies have agreed to pay the City a program surcharge and to indemnify the City against any fines imposed by the State. FISCAL IMPACT There is no fiscal impact associated with this action until July 1998 . At that time the City will receive a 6% program surcharge on the gross receipts of the two companies for temporary construction and demolition materials collected in the City. o'er (9,A- James G.
