The entire and complete proposed new ordinance is conclusive and covers much of the regulations neighborhoods have needed and wanted. The following are especially important elements for food and pedestrian safety, and to aid in being a good neighbor while parked in our neighborhoods: 4. No additional lighting other than that required by the California Vehicle Code may be installed or operated on a food vending vehicle.... 1 5. No operator of a food vending vehicle shall operate any sound amplification system or other sound making devices or music systems ... 7. No owner or operator shall permit the vending vehicle to vend within on hundred (100) feet of a marked or unmarked crosswalk in an intersection. 11. Restocking of a food vending vehicle is prohibited while the vehicle is on any public or private street or alley. 14. No owner operator of a vending vehicle ... nor any object, including but not limited to tables, chairs, other furniture, trash receptacles, generators, or equipment, be placed within or upon the parkway or sidewalk. 16.... one hour or longer must be parked within 200 feet of an approved and readily available toilet and handwashing facility ... Please include my name among those who are in support of the measures detailed in the Community Message below. They appear to be reasonable with clear purpose. I also appreciate the fact that they are not written narrowly as to target a particular type of food truck but rather food trucks in general. The proposed ordinance, which adheres to all applicable state and local laws, is not intended to be punitive, but to protect the health and safety of residents. The issue of regulating food vending vehicles had initially come before the City Council and staff when the City had received complaints from the public, primarily from secondary impacts to food vending vehicles. And while the City had previously enacted food vending vehicle regulations, those ordinances were legally challenged. The City was ordered by a Superior Court judge not to enforce provisions of the existing food vending vehicle regulations. The proposed ordinance, which does not conflict with state or local laws, was prepared based on health and safety findings. Further, to ensure an effective app roach to regulating food vending vehicles, the City took into consideration input from the community, including both residents and stakeholders. Some of the regulations set forth in the proposed food vending vehicle ordinance include the following: • Allows for vending on private property through a land use certificate and/or special event permit • Prohibits vending within 100 feet of a crosswalk. • Prohibits vending on main arterials • Prohibits items in the public right-of-way, such as tables and chairs • Prohibits vending within 500 feet from a school, park, community center, or public playground • Prohibits additional lighting, signs, or amplified sound • Requires vending vehicles to be equipped with refuse containers within a 50 -foot radius These regulations are consistent with state and local public health and safety regulations, including the California Vehicle Code, the Health and Safety Code, and th e County of Orange Health Care Agency's requirements. 2 "The City's intent is to provide clear and concise regulations with regard to food vending vehicles to ensure public safety and prevent traffic hazards, preserve the peace, and safeguard the welfare of the community", said Alvaro Nunez, Code Enforcement Manager. Frankly, I couldn't agree more with it. Santa Ana as it is has major parking issues and the food trucks parking all day in a spot and it's customers do take away that parking availability. Let me give you an example, there's a food truck in which the owner leaves an old car parked to save space, when he comes around with this food truck, he moves that car. He does not live in the area, that I'm aware of. I think the picture I'm sharing summarizes why I support the ordinance. • Prohibits vending within 100 feet of a crosswalk. • Prohibits vending on main arterials • Prohibits items in the public right-of-way, such as tables and chairs Anyway, there are residents who support this measure, it's not like the city is prohibiting the use of food trucks. I was born, raised, and I am an alumnus of the Santa Ana Unified School District. Some of you I have the pleasure of knowing in person, and some of you I have yet to meet. I am writing in regards to the mobile vendor ordinance, I strongly urge the city council to pass the ordinance for the following reasons: I have nothing against people trying to make a living as mobile vendors; in fact, our neighbor is an owner of one of the taco tricks that would be affected by this ordinance. I know this isn't their fault, having the taco truck on West Myrtle Street has caused a plethora of issues in the neighborhood . First and foremost is the issue of safety, I use an electric wheelchair and come to visit my parents often. Many times I'm unable to use sidewalks because people set up tables and chairs on either side of the street, blocking access to the sidewalks. Which in turn, forces me to go around them and take the streets, cars often illegally double park while eating at the taco truck, the double parked cars restrict my vision which it doesn't allow me to be able to determine whether it is safe to cross the street from a safe distance. I've had close calls many times. A resident's access is also restricted to the back alley where most car garages are located because customers decide it's a great parking spot because it's close to the truck, even though the no parking in alley at any time is clearly marked. Another issue is the use of the bathroom, I can recall one day as I was walking to my parents house, a man who had just relieved himself came out of the alley still with his fly unzipped on his pants unbuttoned, with his underwear still exposed, he quickly zipped up and proceeded to receive his food that the taco truck. My parents have walked out to the garage to find fecal matter in the entrance way and various sections of the alley. I'm sure you would all agree this creates a health hazard. My parents shouldn't have to worry about finding fecal matter in the entranceway of their garage, I believe that designated areas for these trucks would solve the issue. Let me reiterate that I'm not against people making their living. However, my parents as residents and taxpayers shouldn't have to deal with what amounts to be a commercial establishment in a residential area. My fundamental right of health and safety should never be trumped by someone's need to make a living. Thank you for your time and understanding.
