THIS SECPND AMENDMENT TO THE ORIGINAL CONSULTANT AGREEMENT is
entered into this 3�y of May 2017, by and between David Morsc & Associates ("Consultant"), and the
City of Santa Ana, a charter city and municipal corporation duly organizer) and existing under the
Constitution and laws of the State of California C City ).
RECITALS
A. The parties entered into Agreement #N-2015-161 dated September 23, 2015 C'Agreemenf') by
which Consultant agreed to provide City with investigation and surveillance services in
litigation matters.
B. On November 30, 2015, the parties entered into a First Amendment of the Agreement
#N-2015-161-001 to provide payment for unpaid sums receivable by Consultant for
services provided prior to the commencement of the Agreement. The First Amendment
specifically authorized payment for those prior services provided by the consultant and no
other terms were amended.
C. In accordance with the terms and conditions of the Agreement, the City desires to exercise the
first one year extension of the tents.
THE PARTIES THEREFORE AGREE:
1, Section 3, TERM, is amended to change the termination date from June 30, 2017 to June
30, 2013.
Except as hereinabove modified in this Second Amendment, the terns of the Agreement and
First Amendment shall remain in full force and effect. In the event of any conflict between the terms
of this Second Amendment and the terms of the Agreement and First Amendment, the tenns of this
Second Amendment shall control.
