PUBLIC HEARINGS PLANNING COMMISSION MINUTES 1 SEPTEMBER 11, 2017 1. SITE PLAN REVIEW NO. 2017-08 AND DENSITY BONUS AGREEMENT APPLICATION NO. 2017-01 (Applicant: AMG & Associates) Legal notice published in the Orange County Reporter on September 1, 2017, and notices mailed on September 1, 2017. Senior Planner Pezeshkpour provided a presentation which included a project description, site description, site and landscape plan, project specifics, and an overview of the density bonus component. Demolish existing motel and restaurant Construct new senior affordable rental residential community, consisting of: 418 affordable senior rental units 1 onsite manager's unit 213 parking spaces Open space (public and private) New landscaping and site amenities throughout California's Density Bonus Law allows applicants to construct long-term affordable units in exchange for greater onsite density To facilitate construction of affordable units, developers may be offered incentives or may request concessionsfrom a local jurisdiction Current law allows an unlimited number of concessions and restricts the ability to require special studies to justify waivers State law allows up to 20% density bonus for senior projects and 35% for other projects City's Housing Opportunity Ordinance allows another 35% density bonus and additional waivers The project is allowed a basedensityof 90 du/ac(dweIIing units per acre) The project site has 3.17 acres. leading to a base density of 285 units With a 20% and a 35% density bonus. the project may build up to 157 additional units, for a total of 442 units The project consists of 419 units PLANNING COMMISSION MINUTES 2 SEPTEMBER 11, 2017 Does the project further the goals of the IAEb1U? No commercial component, but design features wnl activate First Street. > Does the project meet all MEh11.1 development standards? No. setbacks, driveways, and required open Spate areas do not. The applicant has requested incentives/concessions for these items through the Density Bonus Agreement. Conditions and design features will lessen impacts Is the project well -integrated into and will it positively contribute to the surrountling community? The project ndesign is Intended to integrate it as well as possible into the surrounding community through architectural variation and landscaping. > Is the proposed 0.5 -parking space per unit sufficient tot this type of project9 AS 744 allows the applicant to provide lower parking per unit due to the situs adjacency to pubhc transit. The project has been conditioned to require the applicant to enter Into an agreement with a nearby propertyto provide additional guest parking during off-peak hours. where available. Would the project require the incentives/concessions if it contained fewer units? The project could contain more parking and open space if it did not activate the double density bonus. Fewer units would negate the need for some or all of the requested Incentives/concessions. •% Is reducing the publicly -accessible open space supportable? Reducing onsite publicly -accessible open space is generally discouraged unless the projectsite is located nears major public amenity, such as Downtown. No%'ever, the applicant is exercising his rights under the State Density Bonus Law to reduce the required onsite publicly -accessible open space and is increasing the required private open space to compensate. +• Can the project's reduced setbacks be mitigated or will they negatively impact surrountling land uses9 The MEMDs 100 -foot rear setback fora project of this size is more generous then in Santa Ana s other form-basedeode areas. The project has been designed with greater landscaping and bulldmgarticulahon to reduce massing and visual impacts. Based on the State Density Bonus Law and staff analysis, staff recommends that the Planning Commission approve (as conditioned): SPR No. 2017-08 DBA No. 2017-01 Mr. Pezeshkpour noted the applicant requested a concession for off-street parking and open space, while meeting the standard provided by state law. A discussion ensued on the parking for the project. Alexis Gevorgian, applicant, spoke in support of the matter and answered questions. Chairman McLoughlin opened the public hearing. There were no additional speakers and the public hearing was closed. MOTION: Adopt Resolution No. 2017-29 approving Site Plan Review No. 2017-08 as conditioned and Density Bonus Agreement Application No. 2017-01 as conditioned with the removal of Condition No. 3. ZONING ORDINANCE AMENDMENT NO. 2017-02 AND TENTATIVE TRACT MAP NO. 2017-01 (Applicant: Gina Gordon representing Shea Homes) Legal notice published in the Orange County Reporter on September 1, 2017 and notices mailed on September 1, 2017. Commissioner Contreras -Leo disclosed she is a member of the Christ our Savior Parish and has a child attending Segerstrom High School. Commissioner Bacerra disclosed he communicated with Bob Yoder of Shea Homes. Commissioner Nguyen disclosed he is a member of Christ our Savior Parish. Acting Planning Manager Fregoso provided a presentation which included a project description, history of Armstrong Ranch site, landscape plan, site and floor plan, elevations and project analysis. Discussion ensued on the traffic study and traffic on Jaguar Way and size of lots. Applicant spoke in support of the project and thanked staff. Arthur Black, traffic consultant with LSA Associates, answered questions. Discussion ensued on traffic on Jaguar Way and impacts to the new development. Chairman McLoughlin opened the public hearing. There were no speakers and the public hearing was closed. MOTION: Recommend that the City Council: 1. Adopt an ordinance approving Zoning Ordinance Amendment No. 2017-02. 2. Adopt a resolution approving Tentative Tract Map No. 2017-01 as conditioned with two additional conditions that the CC&R's include a provision that requires residents to keep their garage available for parking, and the traffic study shall be amended to include an analysis for potential stop signs at the primary point of ingress/engress to the project. ELECTION OF VICE CHAIRPERSON FOR THE 2017-2018 TERM Consideration of the matter continued from the August 28, 2017 meeting. Recommended Action: Elect a Vice Chairperson of the Planning Commission for the 2017-2018 term. Chairman McLoughlin called for nominations for Vice Chairperson. Commissioner Alderete seconded by Commissioner Verino nominated Commissioner Contreras -Leo as Vice Chairperson. Commissioner Mendoza seconded by Chairman McLoughlin PLANNING COMMISSION MINUTES 4 SEPTEMBER 11. 2017 nominated Commissioner Bacerra as Vice Chairperson. Hearing no further nominations, the nominations were closed. MOTION: Elect Commissioner Contreras -Leo as Vice Chairperson for the Planning Commission for the 2017-2018 term. URBAN DESIGN UPDATE Senior Planner Jill Arabe noted she is the urban designer for the city and provided background information on the Urban Design Section, noted the Visions & Goals, implementing the goals, and projects they are working on along with the General Plan process. COMMENTS 5. STAFF COMMENTS • Acting Executive Director Neal announced Vince Fregoso has been appointed Acting Planning Manager. 6. PLANNING COMMISSION MEMBER COMMENTS Commissioner Nguyen: • Thanked Commissioner Verino for her service chairing the past year. • Congratulated new Chair McLoughlin and Vice Chair Contreras -Leo on their appointment. Commissioner Mendoza: • Thanked the City for their work on the Fiesta Patrias event and wished everyone a Feliz Dia de La Patrias. Commissioner Verino: • Congratulated Commissioner Nguyen on being appointed as representative to the Historic Resources Commission. • Inquired on the disappearance of the public art at CVS at Main & First Streets. Staff will investigate. • Thanked Ms. Arabe for her presentation. Commissioner Contreras -Leo: • Thanked Commissioners for the opportunity to serve as Vice Chairperson and to serve the community. Commissioner Bacerra: • Requested that staff provide a Work Study Session on Granny Flats (Accessory Dwelling Units). PLANNING COMMISSION MINUTES 5 SEPTEMBER 11, 2017 Chairman McLoughlin: Noted the discussion on the issues of the two projects that the Commission reviewed, the challenge of the Commission, and spreading the word on the direction the city is going on regarding housing and land use issues. Ms. Neal noted staff will be looking at these issues in the General Plan and will come back to the Commission with draft policies which will also be a forum to educate the Commission.
