Thank you, Carlos Perea Policy and Programs Director Resilience Orange County H April 3rd, 2018 RE: Defending Sanctuary in Santa Ana Dear Santa Ana City Council Members and Mayor, The undersigned organizations are writing in support of agenda item 85B, a resolution to reaffirm Sanctuary and have the city of Santa Ana join other cities in an amicus brief in support of the state of California against the lawsuit brought forth by U.S. Attorney General, Jeff Sessions, over its recently adopted laws that protect undocumented immigrants. Orange County Board of Supervisors and several other cities such as Los Alamitos, Yorba Linda and Huntington Beach have fueled anti -immigrant sentiment that is divisive and only seeks to create fear and hate in our communities by declaring their stance against SB 54, the state's Sanctuary law. The State of California has taken important steps to support California immigrants by passing SB 54 to prevent local law enforcement resources from being used for immigration enforcement, AB 450 to protect the privacy of immigrants in the workplace, and AB 103 to ensure humane conditions for immigrants in detention. Santa Ana is home to a large population of immigrant families and the only Orange County city to have passed a Sanctuary ordinance, which builds on California law to further protect its immigrant community and prevent City resources and personnel from being used for immigration enforcement. It is important that the city counteracts hateful rhetoric and actions rising in the county by reaffirming its commitment to protect immigrant rights. We will not tolerate the scapegoating of immigrants in our community and we will stand up for dignity, respect and to defend Sanctuary. I want Santa Ana to join in the many other cities against this policy that puts all citizens and non citizens at risk. Our officers are NOT asked to be Federal Immigration Officers, they are only asked to be notified when an illegal alien is released from prison so that they can be processed by our Federal Immigration Officers. As a tax payer and citizen of this city and state I feel you are obligated to follow Federal laws. Plumlee, City Manager From: Warren Kusumoto, Mayor Pro Tem Subject: Introduce Ordinance No. 2018-03 — Adding Chapter 9.30 Constitution of the United States Compliance Summary: This is an opportunity to discuss the Council's desire to show its resolve and support for the Constitution of the United States by adopting a Resolution or Ordinance. Recommendations: 1. Introduce for first reading, read by title only, and waive further reading of Ordinance No. 2018-03; and, 2. City Attorney Daudt read the title of Ordinance No. 2018-03 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOS ALAMITOS, CALIFORNIA, ADDING CHAPTER 9.30 CONSTITUTION OF THE UNITED STATES COMPLIANCE." Background and Discussion The California Values Act (S1354) is contrary to the United States Constitution and infringes on the rights of the citizens of the City of Los Alamitos. Furthermore, it affects the City Council's oath to support and defend the Constitution of the United States. In view of this contradiction, it is impossible to comply with both the Constitution of the United States and the Constitution of the State of California. When two governing documents contradict each other, the order of precedence needs to be invoked and followed. In this situation, my belief is that the Constitution of the United States has precedence over the Constitution of the State of California, so therefore I am proposing that the City Council discuss and adopt Ordinance No. 2018-03 to exempt the City of Los Alamitos from the California Values Act. SECTION 2. Chapter 9.30 Constitution of the United States Compliance is hereby added to the Los Alamitos Municipal Code as follows: 9.30 Constitution of the United States Compliance The City of Los Alamitos, a Charter City, does hereby exempt the City of Los Alamitos from the California Values Act, Government Code Title 1, Division 7, Chapter 17.25 and instead will comply with the appropriate Federal Laws and the Constitution of the United States. SECTION 3. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 4. The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a Certified copy of this Ordinance, including the vote for and against the same, in the Office of the City Clerk, in accordance with Government Code Section 36933.
