However, if the date of first exposure cannot be determined and the bodily <br />injury, property damage or environmental damage continues in fact during <br />this policy period, all such injury or damage shall be deemed to have occurred <br />during the policy period of the first policy issued to you by us or our affiliate <br />providing substantially the same coverage as provided by this Policy for bodily <br />injury, property damage or environmental damage that takes place during <br />the policy period. <br />b. If the same, related, continuous or repeated occurrence(s) or pollution <br />condition(s) take place over the periods of multiple policies issued by us or our <br />affiliate to you providing substantially the same coverage as provided by this <br />Policy for bodily injury, property damage or environmental damage that <br />takes place during the policy period: <br />(1) all such bodily injury, property damage or environmental damage shall <br />be deemed to have taken place only during the policy period of the first <br />such policy in which any of the bodily injury, property damage or <br />environmental damage took place; and <br />(2) all loss arising from all such bodily injury, property damage or <br />environmental damage shall be deemed to have arisen from one <br />occurrence or pollution condition and shall be subject to the limits of <br />liability in effect for such first policy period. <br />6. Extension of Policy Period <br />The Limits of Liability apply to the entire policy period. Any extension of the <br />policy period that occurs after the inception date shall be deemed part of the <br />preceding period for the purposes of determining the applicable Limits of <br />Liability. <br />Deductible <br />We will pay loss in excess of the applicable Deductible set forth in Item 3 of the <br />Declarations. Deductible payments do not erode the Limits of Liability. <br />A separate Deductible will apply to: <br />a. each occurrence, pollution condition or wrongful act; <br />b. the same, related, continuous or repeated occurrence(s), pollution <br />condition(s) or wrongful act(s); or <br />C. any combination of a. and b. above. <br />For Coverage 1B (Personal and Advertising Injury Liability), the Deductible <br />applies to all personal and advertising injury sustained by any one person or <br />organization. For Coverage 2D and Coverage 3, the Deductible includes legal <br />defense costs. If the same, related, continuous or repeated occurrence(s), <br />pollution condition(s) or wrongful act(s) results in application of more than <br />one Coverage, only the highest applicable Deductible shall apply. <br />Upon our request, the first named insured shall promptly reimburse us for <br />advancing any portion of the Deductible we have paid. In the event that the <br />first named insured does not promptly reimburse us for any Deductible amount <br />so advanced, any costs incurred by us in the collection of those amounts shall <br />EPACE001-0415 Page 140 <br />
