NOTICE, RIGHTS AND DUTIES <br />Your Duties in the Event of an Occurrence, Offense, or Wrongful Act <br />It is a condition precedent to coverage that you give us written notice as soon as <br />practicable of any occurrence, offense, or wrongful act which may result in a claim. <br />To the extent practicable, such notice should include: <br />a. How, when and where the occurrence, offense, or wrongful act took place; <br />b. The names and addresses of any injured persons and witnesses; and <br />C. The nature and location of any injury or damage arising out of the occurrence, <br />offense, or wrongful act. <br />Notice of an occurrence, offense, or wrongful act is not notice of a claim. <br />2. Your Duties in the Event of a Pollution Condition <br />a. It is a condition precedent to coverage that you give us written notice of a <br />pollution condition as soon as practicable. Written notice shall contain all of <br />the following information: <br />(1) The cause of the pollution condition; <br />(2) The address of the location where the pollution condition took place; <br />(3) The circumstances under which and the date the insured first became <br />aware of the pollution condition; <br />(4) Bodily injury, property damage, environmental damage or cleanup <br />costs which have resulted or may result from such pollution condition; <br />(5) The name of all insureds that may be subject to a claim and all potential <br />claimants; <br />(6) All engineering information available relating to the pollution condition; <br />and <br />(7) Any other information that we deem reasonably necessary and is <br />reasonably available to the insured. <br />b. You shall have the duty to mitigate and clean up any pollution condition to the <br />extent required by environmental laws, including retaining appropriate <br />environmental professionals. We may exercise our right to require that such <br />environmental professionals have certain professional qualifications, including <br />experience with similar pollution conditions and cleanup costs. We shall <br />have the right but not the duty to review and approve all aspects of any such <br />cleanup. You shall notify us of actions and measures taken pursuant to this <br />Paragraph. <br />EPACE001-0415 Page 141 <br />
