<br />11.18 "Discretionary Project' means a project for which approval requires the exercise of
<br />independent judgment, deliberation, or decision -making on the part of the City. To
<br />determine whether a project is discretionary, the key question is whether the public
<br />agency can use its subjective judgment to decide whether and how to carry out or
<br />approve a project.
<br />11.19 "EIR" means Environmental Impact Report, a detailed written statement setting forth
<br />the environmental effects and considerations pertaining to a project. EIR may mean a
<br />Draft or a Final version of an EIR, a Project EIR, a Subsequent EIR, a Supplemental
<br />EIR, a Tiered EIR, a Staged EIR, a Program EIR, a Redevelopment EIR, a Master
<br />EIR, or a Focused EIR.
<br />11.20 "Emergency" means a sudden, unexpected occurrence, involving a clear and
<br />imminent danger, demanding immediate action to prevent or mitigate loss of, or
<br />damage to, life, health, property, or essential public services. Emergency includes
<br />such occurrences as fire, flood, earthquake, landslide or other natural disaster, as well
<br />as such occurrences as riot, war, terrorist incident, accident or sabotage.
<br />11.21 "Endangered, Rare or Threatened Species" means certain species or subspecies of
<br />animals or plants. A species or subspecies of animal or plant is "Endangered" when
<br />its survival and reproduction in the wild are in immediate jeopardy from one or more
<br />causes, including loss of habitat, change in habitat, overexploitation, predation,
<br />competition, disease, or other factors. A species or subspecies of animal or plant is
<br />"Threatened" when it is listed as a threatened species pursuant to the California
<br />Endangered Species Act or the Federal Endangered Species Act. A species or
<br />subspecies of animal or plant is "Rare" when either:
<br />(1) Although not presently threatened with extinction, the species is existing in
<br />such small numbers throughout all or a significant portion of its range that it
<br />may become endangered if its environment worsens; or
<br />(2) The species is likely to become endangered within the foreseeable future
<br />throughout all or a significant portion of its range and many be considered
<br />"threatened" as that term is used in the Federal Endangered Species Act.
<br />For purposes of analyzing impacts to biological resources, a species of animal or
<br />plant shall be presumed to be endangered, rare or threatened if it is listed under the
<br />California Endangered Species Act or the Federal Endangered Species Act.
<br />This definition shall not include any species of the Class Insecta which is a pest
<br />whose protection under the provisions of CEQA would present an overwhelming and
<br />overriding risk to man as determined by the Director of Food and Agriculture (with
<br />regard to economic pests) or the Director of Health Services (with regard to health
<br />risks).
<br />11.22 "Environment' means the physical conditions which exist in the area which will be
<br />affected by a proposed project, including land, air, water, minerals, flora, fauna,
<br />ambient noise, and objects of historic or aesthetic significance. The area involved
