City of Santa Ana Addendum to the <br />MainPlace Mall Transformation Project Fashion Square Commercial Center Final EIR <br />4 EVALUATION OF ENVIRONMENTAL IMPACTS <br />The evaluation of environmental impacts in this addendum summarizes conclusions <br />made in the 1983 EIR and in the 1996 Addendum and compares them to the impacts of <br />the proposed MainPlace Mall Transformation Project. Mitigation measures referenced <br />are from the Mitigation Monitoring Program adopted as part of the 1983 EIR and are <br />described as either being previously implemented, applicable to the proposed Project, <br />or no longer applicable. <br />This comparative analysis has been undertaken pursuant to the provisions of CEQA <br />and the State CEQA Guidelines, to provide the factual basis for determining whether <br />any of the Proposed Modifications, any changes in the circumstances surrounding the <br />Project, or any new information that has come to light that permits or requires the <br />preparation of a subsequent or supplemental EIR. <br />The analysis herein follows the outline and format, and applies the impact thresholds of, <br />the 1983 EIR, as required by CEQA. (Citizens Against Airport Pollution v. City of San <br />Jose (2014) 227 Cal.App.4th 788.) <br />As discussed in further detail in Section 1.2 Environmental Procedures of this <br />Addendum, pursuant to Public Resources Code section 21166 and State CEQA <br />Guidelines section 15162, when an EIR has been previously certified for a project, no <br />subsequent or supplemental EIR shall be prepared for the project unless the lead <br />agency determines that one or more of the following three conditions are met: changes <br />in the proposed project result in new or substantially more severe impacts than were <br />disclosed in the previous EIR; changes in the circumstances surrounding the project <br />result in new or substantially more severe impacts than were disclosed in the previous <br />EIR; or new information has come to light showing that new or substantially more <br />severe impacts than were disclosed in the previous EIR will occur. <br />Determination Terminology Used <br />For each environmental topic, a determination of the level of significance of the impact <br />is provided, which are organized into the following categories: <br />Substantial Change in Project or Circumstances Resulting in New Significant <br />Effects. A Subsequent EIR is required when 1) substantial project changes are <br />proposed or substantial changes to the circumstances under which the project is <br />undertaken have occured, and 2) those changes result in new significant environmental <br />effects or a substantial increase in the severity of previously identified significant <br />effects.' <br />New Information Showing Substantially More Severe Significant Effects than <br />Previous EIR. A Subsequent EIR is required if new information of substantial <br />importance, which was not known and could not have been known with the exercise of <br />1 CEQA Guidelines.
