Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br />The discussion of cumulative impacts in an EIR must focus on the cumulative impacts to <br />which the identified other projects contribute, rather than on the attributes of other projects that <br />do not contribute to the cumulative impact. The discussion of significant cumulative impacts <br />must include either of the following: <br />(1) A list of past, present, and probable future projects causing related or cumulative <br />impacts including, if necessary, those projects outside the control of the City; or <br />(2) A summary of projections contained in an adopted local, regional or statewide <br />plan, or related planning document, that describes or evaluates conditions <br />contributing to the cumulative effect. Such plans may include: a general plan, <br />regional transportation plan, or a plan for the reduction of greenhouse gas <br />emissions. A summary of projections may also be contained in an adopted or <br />certified prior environmental document for such a plan. Such projections may be <br />supplemented with additional information such as a regional modeling program. <br />Documents used in creating a summary of projections must be referenced and <br />made available to the public. <br />When utilizing a list, as suggested above, factors to consider when determining whether <br />to include a related project should include the nature of each environmental resource being <br />examined and the location and type of project. Location may be important, for example, when <br />water quality impacts are involved since projects outside the watershed would probably not <br />contribute to a cumulative effect. Project type may be important, for example, when the impact <br />is specialized, such as a particular air pollutant or mode of traffic. <br />Public Resources Code section 21094 also states that if a Lead Agency determines that a <br />cumulative effect has been adequately addressed in an earlier EIR, it need not be examined in a <br />la <br />cumulatively considerable. A cumulative effect has been adequately addressed in the prior EIR <br />if: <br />(1) it has been mitigated or avoided as a result of the prior EIR; or <br />(2) the cumulative effect has been examined in a sufficient level of detail to enable <br />the effect to be mitigated or avoided by site-specific revisions, the imposition of <br />conditions, or other means in connection with the approval of the later project. <br />Public Resources Code section 21094 only applies to earlier projects that (1) are <br />consistent with the program, plan, policy, or ordinance for which an environmental impact report <br />has been prepared and certified, (2) are consistent with applicable local land use plans and <br />zoning of the city, county, or city and county in which the later project would be located and <br />(3) are not subject to Public Resources Code section 21166. <br />If the Lead Agency determines that the cumulative effect has been adequately addressed <br />in a prior EIR, the Lead Agency should clearly explain the basis for its determination in the <br />current environmental documentation for the project. <br /> <br />2019 City of Santa Ana Local Guidelines 7-16 ©Best Best & Krieger LLP <br /> <br />
