Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br />Staff may also consult with and obtain comments from any person known to have special <br />expertise or any other person or organization whose comments relative to the Draft EIR would <br />be desirable. <br />In addition, notice shall be given to the public by at least one of the following procedures: <br />(a) Publication of the Notice of Completion and/or the Notice of Availability at least once in <br />a newspaper of general circulation in the area affected by the proposed project. If more <br />than one area will be affected, the notice shall be published in the newspaper of largest <br />circulation from among the newspapers of general circulation in those areas; <br />(b) Posting of the Notice of Completion and/or the Notice of Availability on and off site in <br />the area where the project is to be located; or <br />(c) Direct mailing of the Notice of Completion and/or the Notice of Availability to owners <br />and occupants of property contiguous to the project, as identified on the latest equalized <br />assessment roll. <br />The Notice of Completion and Notice of Availability shall be posted in the office of the <br />Clerk in each county in which the project is located for at least thirty (30) days. If the public <br />review period for the Draft EIR is longer than thirty (30) days, the City may wish to leave the <br />Notice posted until the public review period for the Draft EIR has expired. <br />Copies of the Draft EIR shall also be made available at the City office for review by <br />members of the general public. The City may require any person obtaining a copy of the Draft <br />EIR to reimburse the City for the actual cost of its reproduction. Copies of the Draft EIR should <br />also be furnished to appropriate public library systems. <br />The City is encouraged to make copies of filed notices available in electronic format on <br />the Internet. Such electronic postings are in addition to the procedures required by the CEQA <br />Guidelines and the Public Resources Code. <br />7.26 S UBMISSION OF D RAFT EIR TO S TATE C LEARINGHOUSE. <br />A Draft EIR must be submitted to the State Clearinghouse for review by state agencies in <br />the following situations: <br />(a) A state agency is the Lead Agency for the Draft EIR; <br />(b) A state agency is a Responsible Agency, Trustee Agency, or otherwise has jurisdiction by <br />law over resources potentially affected by the project; or <br />(c) The Draft EIR is for a project identified in State CEQA Guidelines Section 15206 as <br />being a project of statewide, regional, or area-wide significance. <br />State CEQA Guidelines Section 15206 identifies the following types of projects as being <br />examples of projects of statewide, regional, or area-wide significance that require submission to <br />the State Clearinghouse for circulation: <br />(1) General plans, elements, or amendments for which an EIR was prepared; <br /> <br />2019 City of Santa Ana Local Guidelines 7-23 ©Best Best & Krieger LLP <br /> <br />
