Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) INITIAL STUDY <br /> <br />5.12 D EVELOPMENT P URSUANT T O A N E XISTING C OMMUNITY P LAN A ND EIR. <br />Before preparing a CEQA document, Staff should determine whether the proposed <br />project involves development consistent with an earlier zoning or community plan to <br />accommodate a particular density for which an EIR has been certified. If an earlier EIR for the <br />zoning or planning action has been certified, and if the proposed project concerns the approval of <br />a subdivision map or development, CEQA applies only to the extent the project raises <br />environmental effects peculiar to the parcel which were not addressed in the earlier EIR. Off-site <br />and cumulative effects not discussed in the general plan EIR must still be considered. Mitigation <br />measures set out in the earlier EIR should be implemented at this stage. <br />Environmental effects shall not be considered peculiar to the parcel if uniformly applied <br />development policies or standards have been previously adopted by a city or county with a <br />finding based on substantial evidence that the policy or standard will substantially mitigate the <br />environmental effect when applied to future projects. Examples of uniformly applied <br />development policies or standards include, but are not limited to: parking ordinances; public <br />access requirements; grading ordinances; hillside development ordinances; flood plain <br />ordinances; habitat protection or conservation ordinances; view protection ordinances; and <br />requirements for reducing greenhouse gas emissions as set forth in adopted land use plans, <br />policies or regulations. Any rezoning action consistent with the Community Plan shall be <br />included in the general plan; (2) complies with Article 5 (commencing with Section 65300) of <br />Chapter 3 of Division 1 of Title 7 of the Government Code by referencing each of the mandatory <br />elements specified in Government Code Section 65302; and (3) contains specific development <br />policies adopted for the area in the Community Plan and identifies measures to implement those <br />policies, so that the policies which will apply to each parcel can be determined. <br />5.13 L AND U SE P OLICIES. <br />When a project will amend a general plan or another land use policy, the Initial Study <br />must address how the change in policy and its expected direct and indirect effects will affect the <br />environment. When the amendments constitute substantial changes in policies that result in a <br />significant impact on the environment, an EIR may be required. <br />5.14 E VALUATING I MPACTS ON H ISTORICAL R ESOURCES. <br />Projects that may cause a substantial adverse change in the significance of a historical <br />resource, as defined in Local Guidelines Section 11.28 are projects that may have a significant <br />effect on the environment, thus requiring consideration under CEQA. Particular attention and <br />care should be given when considering such projects, especially projects involving the <br />demolition of a historical resource, since such demolitions have been determined to cause a <br />significant effect on the environment. <br />Substantial adverse change in the significance of a historical resource means physical <br />demolition, destruction, relocation or alteration of the resource or its immediate surroundings, <br />such that the significance of a historical resource would be materially impaired. <br /> <br />2019 City of Santa Ana Local Guidelines 5-12 ©Best Best & Krieger LLP <br /> <br />
