Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br />7.04 S PECIAL N OTICE R EQUIREMENTS FOR A FFECTED M ILITARY A GENCIES <br />CEQA imposes additional requirements to provide notice to potentially affected military <br />agencies when: <br />(a) ction 11.42 of these Local Guidelines) has provided <br />the City with its contact office and address and notified the City of the specific <br />-11.37 of these Local <br />ction 11.41 of these Local Guidelines), <br />11.67 of these Local Guidelines); and <br />(b) The project meets one of the following criteria: <br />(1) The project is within the boundaries specified pursuant to subsection (a) of this <br />guideline; <br />(2) The project includes a general plan amendment; <br />(3) The project is of statewide, regional, or area-wide significance; or <br />(4) The project relates to a public use airport or certain lands surrounding a public use <br />airport. <br />When a project meets these requirements, the City <br />designated contact with any Notice of Preparation, and/or Notice of Availability of Draft EIRs <br />that have been prepared for a project, unless the project involves the remediation of lands <br />contaminated with hazardous wastes and meets certain other requirements. (See Public <br />Resources Code Sections 21080.4 and 21092 and Health and Safety Code Sections 25300, <br />et seq.; 25396; and 25187.) <br />The City must provide the military service with sufficient notice of its intent to certify an <br />EIR to ensure that the military service has no fewer than thirty (30) days to review the document; <br />or forty-five (45) days to review the environmental documents before they are approved if the <br />documents have been submitted to the State Clearinghouse. <br />It should be noted that the effect, or potential effect, a project may have on military <br />activities does not itself constitute an adverse effect on the environment pursuant to CEQA. <br />7.05 E NVIRONMENTAL L EADERSHIP D EVELOPMENT P ROJECT. <br />Under certain circumstances, a project applicant may choose to apply to the Governor of <br />the State of California to have the project certified as an Environmental Leadership Development <br />Project. Only large, privately funded projects that will result in a minimum investment of $100 <br />million in California upon completion of construction and that create high-wage, highly skilled <br />jobs without resulting in any net additional emission of greenhouse gases, will qualify for <br />certification. All construction workers employed in the execution of the project will receive at <br />least the general prevailing rate of per diem wages for the type of work and geographic area, as <br />determined by the Director of Industrial Relations pursuant to Labor Code Sections 1773 and <br />1773.9.
