("Contractor"), and the <br />City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. A-2019-103, dated July 2, 2019, by which <br />Contractor agreed to provide right-of-way and median landscape maintenance services for <br />the Maintenance Services Division of the Public Works Agency ("Agreement"). The <br />original term of the Agreement is for two years, and the Agreement remains in effect through <br />June 30, 2021, with provision for extension. <br />B. The parties wish to amend the Agreement to increase the scope of services and the amount <br />expended under the Agreement to cover debris removal services on an on -call basis in order to <br />address the impacts of homelessness. <br />The Parties therefore agree: <br />1. Section 1, Scope of Services, is amended to include debris removal and homeless encampment <br />clean-up services on an on -call basis, as described in Exhibit A-1 to this First Amendment. <br />2. Section 2, Compensation, is amended to increase the not -to -exceed expenditure under the <br />Agreement from $770,000 to $1,020,000 for the one-year term ending on June 30, 2020, and <br />to include the rates and charges identified in Exhibit B-1. <br />3. Except as modified by this First Amendment, all terms and conditions of the Agreement shall <br />remain in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to the <br />Agreement on the date and year first written above. <br />ATTEST „►�W,.
