When the absence is for more than three (3) consecutive working days, upon return <br />to workk the employee must present to his/her Department Head a physician's <br />certificate stating that the employee could not report to work because of such illness <br />or injury, and advising that the employee is sufficiently recovered to safely return <br />to work. Such certificate shall be forwarded to the Executive Director of Human <br />Resources. <br />Upon written request by a Department Head or designee, a physician's certificate, <br />or other satisfactory written evidence of the need for qualified sick leave usage, <br />may be required after any future absence of any duration less than three (3) days. <br />Such written notice shall be approved by the Department Mead or designee and the <br />stated reason therefore. <br />H. Denial <br />No employee shall be entitled to sick leave with pay while absent from duty because <br />of sickness or injury purposely self-inflicted or caused by willful misconduct; or <br />because of sickness or injury sustained while engaged irk employment, other than <br />employment by the City, for monetary gain or other compensation; or due to other <br />reasons resulting from engaging in any business or activity for the purpose of <br />personal monetary gain or other compensation. <br />1. Personal Necessity Leave <br />Each employee shall be afforded the opportunity to use up to forty-eight (48) hours <br />of sick leave per calendar year, on a non -cumulative basis, as personal necessity <br />leave. <br />1. Family Sick Leave <br />a. Personal necessity leave may be used to attend to an illness of a family <br />member. <br />b. A "family member" means any of the following: <br />• A child, which for purposes of this article means a biological, adopted, <br />or foster child, stepchild, legal ward, or a child to whom the employee <br />stands in loco parentis. This definition of a child is applicable <br />regardless of age or dependency status. <br />• A biological, adoptive, or foster parent, stepparent, or legal guardian <br />of an employee or the employee's spouse or registered domestic <br />partner, or a person who stood in loco parentis when the employee <br />was a minor child. <br />• A spouse <br />• A registered domestic partner <br />2019-2022 MOU City of Santa Ana & SEIU Full -Time Employees Unit Page 59� <br />i� <br />
