Statement of Qualifications <br />City of Santa Ana Public Works Agency - Water Resources Right of Way Acquisition Services (RFP 20-091) <br />• Document Recordation — Our Agents are familiar with the procedures and requirements of the <br />County Recorder's Office and have assisted with the recordation of hundreds of documents over <br />the years. <br />Acquisition Services <br />Right of Way Acquisition Process <br />Following is an abbreviated description of the proposed acquisition process: <br />The acquisition function will be led by Project Manager, Mike Flanagan, SRANA. Mike is knowledgeable <br />in the Uniform Relocation and Real Property Acquisition Policies Act (URA), Title 25 and 49 CFR part 24. <br />The acquisition task begins with the final identification of the parcels that need to be acquired. <br />The acquisition agent will draft contracts and other required documents using forms approved by the <br />City. Contracts, Purchase and Sale Agreements, Rights of Entry and Deeds will be prepared based on <br />the appraisals produced for the project. <br />After City approval of the documents prepared by Clark Land, appointments will be scheduled with each <br />Owner in order to present the first written offer in person (in accordance, [and if allowed] with COVID <br />restrictions). At the initial appointment, the agent will discuss the project, its overall impact on the <br />community, their rights under the Uniform Act and attempt to answer all questions the owner may have. <br />Owners will be presented with the summary of the basis of appraisal, the contract document and the <br />appropriate Uniform Act brochure will be delivered to the owners. <br />Our acquisition agents strive to make at least 3 personal visits with each grantor within the initial 30-45 <br />days of package approvals. If relocation is required, Clark Land relocation agents will conduct their initial <br />advisory interviews with displacees within the first week after first written offers are presented. <br />Negotiations with Property Owners: Negotiations with each owner will continue until the contracts are <br />signed. If an owner suggests edits to any contract language those suggestions will be cleared with the <br />City prior to being authorized. Once a property owner has signed the purchase and sale agreement, <br />contract and/or easement for a property, Clark Land will immediately deliver the executed documents to <br />the City for counter signatures. Fully executed documents will be delivered to escrow whereby Clark <br />Land will assist the escrow officer with any additional requirements necessary until the transaction is <br />closed, conveyed and recorded. <br />If a property owner chooses to obtain his own private appraisal, the Clark Land Agent will seek to obtain <br />a copy of that report and supply the copy to the City for consideration. <br />Administrative Settlements and Condemnation: From time -to -time, an owner may refuse to grant the <br />required rights to the City. If after good faith negotiations have been conducted for a reasonable period, <br />no agreement is reached and negotiations reach impasse, this information will be reported to the City. <br />Clark Land team members are familiar with administrative settlements and eminent domain. Taking <br />direction from the City, Clark Land will attempt to settle any outstanding acquisitions, report owner <br />demands or propose logical compromises to the City. <br />All administrative settlements will be preapproved by the City prior to presentation to a property owner. <br />Should condemnation be required, Clark Land team members are experienced with preparation of <br />Notices of Intent (NOI) to Adopt a Resolution of Necessity (RON) and statutory time frames for sending <br />those notices to the property owners. (The cost for these services is not included in the cost estimate <br />[which is provided separately from this proposal]. If required, Clark Land will develop an amendment to <br />the current task order with an estimate of the costs for these services.) <br />25D-283 Page 11 of 19 1 Clark Land Resources, Inc.
