F:JAl.l.(BIT I{ <br />F EDERAL CONTRACT PROVISIONS <br />During the performance of this contract, SIJ13RtECJPI IT (or "Vendor") shall comply with all applicable <br />federal laws and regulations, including but not limited to, tite federal contract provisions In this Exhibit, in <br />this Exhibit, the term "Agency" shall mean the CITY as the local agency entering into this contract with the <br />Vendor, <br />1. CONTRACTING WITH SMALL AND MINORITY BIRiMIS, WOMM? S J)usI 88 <br />ENTERPRISE AND LABOR SURPLUS AREA FRtMS (2 C.Ir.R. § 20(),3zi) <br />(A) Vendor shall be subf oct to 2 CXA. § 200.321 and wilt take affirmative steps to assure <br />that minority firms, women's business enterprises, and labor surplus area firths are used <br />when possible aunt will not be discriminated against on the grounds of race, color, <br />religious creed, sex, or national origin in consideration for an award, <br />(B) Affrmadve steps shall include; <br />0) Placing qualified small and minority businesses and women'$ business <br />enterprises on solicitation lists; <br />(11) Assuring that small and minority businesses, and wornetAL business enterprises <br />are solicited whenever they are potential sources; <br />(111) Dividing total requirements, when economically feasible, into smaller tasks or <br />quantities to permit maximum participation by stnall and minority business, <br />and womeds business enterprises; <br />(lv) Establishing delivery schedules, where tho rMuiremcsrt permits, which <br />encourage participation by small and minority business, and warnen's business <br />enterprises; and <br />(V) Using the services/assistance of the Small Business Adnunistration (SBA), and <br />the Minority Business Development Agency (Mh3DA) of the Department of <br />Commerce, <br />Vendor shall submit evidence of compliance with the foregoing affirmative steps when requested by <br />the Agency, <br />Notwithstanding the foregoing, the affirmative steps requirements detailed above do not apply in the <br />case of a noncompetitive procurement made under the emergency exeepticn/exigency exception to <br />competitive prooutetnents, <br />2. COST PRINCIPLES (2 C.F.R.
