Drum Noe WnjiTjliM <br />The SUIIRECIPIENT represents and warrants that it has established the following drug -free <br />workplace policy, <br />(1) The unlawful manufacture, distribution, dispensing, possession, or use of a controlled <br />substance is prohibited in the workplace for any employee involved in a federally funded <br />program, <br />(2) As an etnpioyec working in conjtuaction with a federally fended program, the: employcos <br />of the SUBRE+C1PIEn,NT wilt be required to: <br />a. Abide by the ternns above in statement (1), and <br />b. Notify the appropriate SUBRECIPWNT authorities and CITY officials of any <br />criminal drug statute conviction for violation occurring in the workplace, Such <br />notification shall be made no later than five (5) days after conviction. <br />(3) The CITY and the United States Department of Dousing and Urban Development will be <br />notifted wifhfn ton clays after recctvtng notice of any such violation. <br />(4) Within thirty (30) days of receiving such notice, appropriate personnel action will be <br />taken against such employee; up to and including termination. <br />(5) Ltac:h such employee shall be required to participate satisfactorily in a drug abuse <br />assistance or rehabilitation program approved for such purposes by a Federal, State or <br />Local health, law enforcement, or other appropriate agency. <br />E. i)igiouc Organisation <br />The SU13MCtpIENT may not engage In Inherently religious activities, such as worship, religious <br />instruction, or proselyfim&ion as part of said program or services. If the SUI3RECIPIEN`1' <br />conducts such activities, the activities must be offered separately, in time or location, fronn said <br />programs or services, and participation must be voluntary for the program pa ticipants. <br />The SUBRECIPIENT shalt not, in providing program assistance, discriminate against a program <br />participant or prospective program participant on the basis of religion or religious belief. <br />If the SUBRECI IR IT is a religious organization, it retains its indeppendence from Federal, State, <br />and Local governments, and may continue to carry out its mission, including the definition, <br />practice, and expression of its religious beliefs, provided that the religious organlzation does not <br />rise direct ESG fiends to support any inherently religious activities, <br />The SUDRECiPIEN'T' agrees that rehabilitation of structures by the religious organization in <br />connection with said program must be in sound accord with the provisions under 24 CpR § <br />576,40, <br />12 <br />
